Hi ,

I had my visa interview on 14th June and at the end of the interview i was told by the CO that yous visa has been approved and he kept my passport n said you will receive your visa within a few days ..after 2 days i got my passport back along with a letter which states that YOUR CASE IS KEPT PENDING UNDER SECTION 221G AND WE WILL CONTACT YOU WHEN IT IS DONE ..and my i797 notice expiration date is 30 July.. that makes me worried ..

1 , what do u think is the probable cause of keeping me in AP after approval ?

2 ,what will happen if i don't get the visa before July 30th ? will my petition expire n do i have to file it again ?

Nothing to worry about. There's probability that some of the paperwork you presented triggered a red flag and the embassy is trying to conduct a finding which everybody knows as administration processing AP.

Moreover, mayb while going thru your emails or other evidence submitted, they're not too sure of the evidence and hence they wanted to ensure that what you claimed to submit is actually authentic and genuine.

The embassy have the power to extend your visa processing beyond July 31st and you don't need to file again.

Just keep praying and hopeful, everything will be fine...

call and call and bother them. go in person. cause a ruckus. you have to get the info needed. this is ridiculous. did u email VFS?? if the american is in india they can go make an apt. for the embassy and then go and talk to someone at window j24 or j25 and ask what happened. first you will have to go to the u.s. side then make sure a security guard escorts you to the lady who will give you your number, or if u have been to the embassy before and have confidence go ahead and just do it yourself but you need to know where to go.

WARNING that fat #### blonde lady that works in the middle window of the u.s. embassy on american side is a ######. she will not help you and is really annoying. when u enter the american side try and go left behind the secruity door and speak to someone in CIS but generally no one is there. they will more then likely make you go to ACIS and then just make ACIS send you to window j25 make up something like they told u to go to that window. then you have to walk back out and head over to where the interview was taken. i think interview is taken at j22 window or something like that but that window wont talk to you. u have to go to j25 window. a younger girl with long curly hair is pretty helpful and nice. you have to be confident with them. DO NOT LEAVE unless u get the info you want. insist upon it but diplomatically, not like a psycho bc they are still processing your file and you dont want it denied.

This is what i got in reply when i e mailed the consulate regarding my case .

The case is under administrative review. This is an internal process.

Unfortunately, we cannot predict when our review will be completed, but

we will do our best to process the case expeditiously with the confines

of our resource limitations. We will contact you once we complete

administrative process of your case.

AP can last a few weeks, a few months or a year and a few cases even longer. There is no way of knowing how long it will take. There is nothing you can do to speed up the process.

If you are unable to get a precise answer from the CO on the phone or in person what they are reviewing, verifying or investigating, then just call DOS by weekly or so to inquire about your status. Depending on which agent you will get to answer the phone you may or may not get a little bit more info.

DOS phone # is 202-663-1225, press 1,0.

You can ask precise questions like, is the beneficiary in name checks or security checks or is it document verification.

The unknown time frame is stressful but you might as well just try to relax and allow the process to take it's course.

Consulate Received : July 30,2014 Transfer to right embassy complete.

Interview Date : Oct 22, 2014

Interview Result : AP , requesting another PC (not expired) and certified divorce decree (was submitted)Stokes interview via phone for petitioner 4 hrs after interview.

Oct 23 email notification visa approved.
Visa Received : Nov. 3 , 2014 VISA IN HAND.

US Entry : Nov. 21, 2014

Marriage : Dec 27, 2014

AOS send : May 12, 2015, received May 14, 2015 USPS priority

Email &text : May 18, 2015, check cashed May 19,2015, return receipt May 21, 2015 stamped USCIS Lockbox, NOA1 (3x) May 22,2015

Biometrics : June 1, 2015 letter received for appointment June 8, 2015, successful walk-in June 1, 2015

RFE : June 12, 2015 for income not meeting guideline. Income does ( ! ) exceed guideline.

RFE response : June 26, 2015 returned with a boat load full of financial evidence.

UPDATE: July 5, 2015 updated on all 3 cases, RFE received June 30, 2015.

Service request : Aug 12, 2015, letter received that it will be processed within 90 days from receipt of RFE.

UPDATE: Aug 24, 2015, EAD card being produced/ordered. ( 102 days from AOS receipt day and 55 days from RFE response received.) Thank you Jesus !

Emails : Aug 24, 2015, EAD approved, EAD card ordered.

I-797 EAD/AP approval notice received : Aug 27, 2015

EAD/AP combo card mailed : Aug 27, 2015, EAD/AP combo card received: Aug 31, 2015

Third Biometrics appointment letter received Aug 19, 2016 for Sept. 1, 2016. WTH ?!

EAD/AP (renewal) approval Aug 22, 2016, NOA2 received Aug 25, 2016

Renewal EAD in production notification text and online, expedite successful 4 days after RFE request response was faxed, Aug25mailed,Aug29received.

Sept. 21 Interview, 2 hour interview, we were separated and asked about 50 questions each for an hour each. IO was firm but professional, some smiles.
Several service requests made, contacted Senator and Ombudsman. Background checks still pending.
July 21, 2017 HOME VISIT.  Went well. Topic thread in AOS forum.
Waiting to skip ROC and get 10 yr GC due to over 2 year while pending AOS
AOS APPROVED Oct. 4, 2017 * Green card in hand Oct 13, 2017 !!!!!

First K1 denied after 16 month of AP. Refiled. We are a couple since 2009. Not a sprint but a matter of endurance.
