I-864 please Help!!!

Hello everyone..

This is the first time posting.. So here we go, any help will be much appreciated..

We are currently filing form I-864, affidavit of support.

I am the petitioner and my husband is the beneficiary and we have one child.

We are both self employed with our own company but I often work seasonal part time jobs also.

With our income we meet the 125% poverty guidelines. We were wondering if we should still put his income and mines combined even though he is not a legal resident. In the affidavit of support, it states that we can put his income down only if the source of income will still be the same, which in our case it will be since we are self-employed. We have all proper documentation for us owning our own company...

so will a letter stating that our income will be the same after he becomes a legal permanent resident enough since it is our own company?

Also, this is the first year we have both filed taxes jointly because it is our first year being married and therefore cannot provide our previous tax year returns. Before this year I was a dependent in my parents tax returns and he never filed taxes before because his income was not enough to file. Will a letter stating this also help us prove why we have not filed taxes in the previous years?

IF he will continue the same job and doing the same thing then it says he can use that income but there has to be undeniable proof that his income will continue and he will continue the same job... fyi find out who was self employed that filed an 864 it can be a bit tricky from what ive seen because it has to be clear which is business account etc...

hopefully someone will also come along and post about using income from foreign spouse.... good luck

Well he will still be working with the same things because he does computer design an will keep doing so afterwards, we just are not sure if a letter from us will be enough proof.

For a self employed person the income evaluated is from line 22 of their most recent (2010 in this case) form 1040 US tax return.

What is the income on line 22 of your 1040? That is your income for the affidavit of support, not projected 2011 income.
