CO Gave Husband originals back but we think they gave back the divorce decree

My husbands interview was june 15th and during the process they were looking over all the documents obviously... at the time they also gave him back all the original documents per our request as we sent certified copies as well (and then by accident some extras they should have kept). However, since we didn't need the divorce decree back we didnt' request this to be returned however, today as my husband finally came around to his senses we have been talking and going thru the documents because we need to submit proof my son is 18 not living with me and that he is not claimed on taxes by me etc to be able to exclude him from household.

During this, my husband realized that they were having issues during the last part of the interview in finding documents and kept saying they can't find them so my husband said I have one and gave them his and they looked at his and returned it to him.

my husband thinks it was a genuine mistake as they were beyond ending time and trying to complete the interviews and anxious to leave and they may have sent back to us the court certified copy of the divorce decree as well as the parenting agreement that shows the responsibility for my son which would be why they coulndt find it in interview. (we are sending the info back about the son anyway so that won't be an issue)but they kept the original nikah nama even tho we submitted a certified copy. how do we find out how to send back the divorce decree but receive the original nikah nama?

Can we attach a note in with the divorce decree saying we thought they may have given it back by mistake and are resending it back to them and request the original nikah nama as they should have a certified copy?

How can we correct this? They need to have my divorce decree in the file and I'm not sure if they have one...just want to be safe and be sure they have everything...it seems an honest mistake during the confusion of thelast of the day... :(

Help anyone pleasE?

BTW...there were several CO's looking in his files and different ones would hand papers back at different intervals thinking he didnt get his originals back...?? By the time the last person looked at the file is when they were saying they couldnt' find documentation and my husband hadn't realized at that time that they couldnt find it bcos they gave it back to him...

We did a total check and it looks like they have all our documents except maybe the divorce decree.... half of the ones are certified copies and the other half are originals giving certified back instead of original but all documents one way or another they still have. Can anybody tell me how to correct this? Does the embassy also get the documents sent from i 130? If so, then they do have a copy of the divorce...

Can anybody share any ideas please?

i dont know if u will find this helpful..but anyways...

My original birth certificate and certified translation was submitted with the I 130..USCIS asked for it...But when my case reached NVC they sent me "checklist" asking for birth certificate,,,,....

I had to get another one issued...

...I guess the embassy only has the NVC case file..!!

We submitted an original and certified copy of each original for the NVC portion.. only copies were sent for the 130....

I think there were some confusion during his interview process and one person gave back some originals leaving cert copy in place and then the next person gave back certified copies leaving the original in place but it seems the embassy still has an entire packet between orignals and cert copies... maybe or maybnot the divorce decree...we are unsure about that...

we just wanted to know how to find out how to obtain the originals and return the cert copies and see if they still have the divorce decree...

they aren't asking for this... we just want the originals back..that's all.. but there was just confusion going on at his later hour of interview..thats it.. :(

Ok CO kept your orginal Nikah Nama? did your husband asked for it or not. as far as i remember one of Vj member had his interview at ISB embassy and they kept his passport & orginal Nikah nama too, as per his statment they told him that Nikah nama will be return with passport,. at the time of my interview Co returned all my orginal documents, which i submitted earlier, i don't get it when you have submitted cerfied copies there is no reason to keep orginal papers with them.

Timeline

They're not required to have originals in their file for divorce decrees. They can ask to examine the original, but they only need to keep copies. If they already have a copy then there's no reason they'd need to keep the original. I wouldn't worry about it unless they ask for it.

HI ABBAS you dont worry about the original nikha nama or marriage certificate they cant return you untill they cannot verified your original marriage certificate document and also you dont worry about the divorce decree certificate your divorce chapter has been closed consular officer satisfy about your divorce issue that why at the end of your husband interview consular have no objection about your divorce issue he cannot say or ask to your husband any things about your divorce issue and consular officer cannot raise any divorce question at the end of your husband interview which mean they satisfy about divorce issue. that why consular officer simply say or demand to your husband we cannot issue or approved your visa untill your wife cannot prove that she is not responsible and support his 18 year old son or she cannot provide documented proof and evidence that her exhusband is responsible and support for his 18 year old son which mean consular officer satisfy all your original document proof and evidence and consular officer is able to issue and approve your husband visa untill you cannot fullfill his requirement or demand and please dont raise your divorce case again with embassy untill embassy cannot demand you any further document because your one wrong step create your case more complicated and embassy officer doubtful about your divorce case if embassy need any document they inform you by email or cell phone and avoid it and my request to you that you only concentrate and focus to collect your 18 year old son original documented supporting proof and evidence when you collect all document send to embassy immediately

i think everyone misunderstands... we got back allll the originals like we asked but a couple of them were certified copies instead of originals. We sent both original and certified copy so it would leave them with a cert copy and us the originals. We just wanted original nikah nama back. they gave us the certified copy instead. But they have a full set of copies between the original and the certified. We have a full set (was supposed to be all originals) but we got a few certified copies instead of original. that's it... thats why we wondered... he had one person hand back a few of the originals, then at a later time he had another person had back the rest of the originals but they had mistaken cert copies for originals...thats it...

Just wondering if we can request the originals back or maybe they send back at the time of visa issuance? Yes we are submitting documents today/tomorrow....everything is ready it was just difficult to expect someone who is not versed in law to be able to decipher a 30 page document detailing child support so we had attorney summarize and condense evidence.

Our nikah had cert translation as well as registered with NADRA so there is no issue for the marriage that was settled at the interview.

Yeah they handed him the certified copy instead...he was confused towards the end of the day he had been there all day.... im sure they will return it as well if they realize its original...i think it was just genuine mistake... he said it was a new guy even he said he ws new at this...so im sure it was just a mistake handing back certified copy of nikah instead of original...we still have one original tho..so i guess it doesnt matter..

they kept his passport and gave him a pink token ... they are just waiting for our other documentation and he is in ap as of right now... we will just leave it as it is..we have an original nikah nama we received two.... just thought id ask ...and it sounds like they may return the nikah nama once visa is issued as well...

(not sure i understood about waht you meant by returning the petition to uscis)

but there was no discussion about returning out case to uscis just they wanted either co sponsor or proof my son isnt' dependent upon me. told my husband to return the documents thru this token and that his visa would also be issued thru this.... dont know how long ap lasts but it lasts as long as it does i guess.. thanks jim

Once the visa is issued they don't keep your documents at the consulate. Your petition package will be sent back to USCIS, along with all of the documents you submitted, to become part of his permanent immigrant record. USCIS will have scans of everything available in their computers, but the actual paper documents will be sent to a long term storage facility until the next time they're needed, perhaps when your husband removes conditions on his green card. Once USCIS has the documents back in their possession then you can ask for any original document to be returned.

Your petition package will be sent back to USCIS, along with all of the documents you submitted, to become part of his permanent immigrant record. USCIS will have scans of everything available in their computers, but the actual paper documents will be sent to a long term storage facility until the next time they're needed, perhaps when your husband removes conditions on his green card. Once USCIS has the documents back in their possession then you can ask for any original document to be returned.
