My husband and I are still in the process of our Direct Consular Filing case-We filed I-130 and have our interview in July Thank God!

The thing is, if all goes well and e do go to the USA, we are wanting to start college next year. I know that when I and my friend agreed to sponsor my husband we signed the paper saying we wont recieve any government aid. So is filling out the Fafsa for financial aid for college considered in this? I'm just wondering because according to the college we are looking at, we have to fill out the Fafsa in order to apply for scholarships. We don't necessarily want the financial aid if we can avoid it through saving, but I was wondering if financial aid for college is considered in that. I read a lot of greencard holders get financial aid for college, and I was wondering how that effects the contract with the US.

If anyone knows, it'd be great to know lol Thanks!

Recieved Joint Sponsors Packet- 05/16/2011

Sent Application via UPS to US Embassy in Ankara- 5/17/2011

On 5/31/2011 Called Embassy to Inquire about application-received interview date for 7/12/2011

Interview-waited 2.5 hours-lasted 5-10 minutes. APPROVED!!!! YAY!!!

What a surprise!!

I filed FAFSA and didn't even think about the affidavit of support:) I'm not 100% sure, but since GC holders are eligible for financial aid and most of them are sponsored by someone, that should mean filing FAFSA is legal.

I did not qualify for FA anyway, I have too much education already  Those who have a bachelor's or will have received bachelor's by the beginning of the school year don't qualify.

My suggestion would be to contact USCIS directly and ask them. When I hear about aid I am thinking more so in the terms of like WIC or aid pertaining to living expenses not necessarily aid for going to school. However, to be on the safe side and to ensure that you do not do anything you are not supposed to, I would contact USCIS, and take note of who you talk to and the date and time you called and get their agent # or ID. Also, you could also ask for a Tier 2 person just to ensure you are getting the fullest amount of information possible. I can tell you from a past experience however that I knew of several green card holders who were able to utilize financial aid for schooling. At the time, and this was several years ago, the stipulation regarding aid was more so in reference to receiving like section 8 housing and aid for buying food and things along those lines.

Thank you all for your answers. This really helped. I don't think we're going to actually use the financial aid, but we read that we have to fill out the Fafsa to even get scholarships =/ So, I didn't want there to be any risk. Thank you everyone!!!

All the financial information that the FAFSA has in it is information straight from your tax returns. So as long as the information in the FAFSA is the same as what is in the transcripts you send to USCIS, then you've got no problem. Like you say, filing a FAFSA is not at all equivalent to pleading poverty! When universities average $40K per year in tuition, who has that kind of money laying around!!
