Dear VJ members:

I need your help as I have no idea how to fill out this part 7 of the application. I am applying for naturalization based on my marriage to my US husband of over 3 years. I came to the US in Oct 2007 on a K-1 and we got married. I was granted a permanent resident status in Feb 2008.

My question: What do I put in terms of the number of days I spent outside the US during the past 5 years? Do I need to count the days I was in my home country before I came here to marry my husband? I am confused and it doesn't seem to make sense to me when I am applying for the citizenship based on a marriage to a US husband.

Please help. I have zero idea how to go about this.

No, if you're applying with the 3-year marriage based eligibility, you just count the days outside of the US in that 3-year time period. Good Luck

Was tempted to write in with a pencil a question mark with that question. Table below that wants you to record all of your trips lasting over 24 hours since becoming a LPR. Could have added a total under that table for the total number of days outside of the country. That total could be inserted into that question, but the question doesn't ask that, asks the total number of days outside of the country in the last five years with no mention of when you became a LPR. So even that five years is not accurate.

This was been done by Emilio that was canned as the director of the USCIS that really messed up the N-400 application, guy couldn't even speak English. Since then, about three acting directors that only changes made was to where to send the application, but nothing done to correct the N-400.

You are at the mercy of your IO, can deny your application if you cross out that five and make it a three, or just let it go, not legally ethical to change the form. Or may get upset because you did answer the question the way it was asked. We did the later, can't be argued as that was what the question asks, how many days where you out of the country in the last five years. Got this from a very experienced immigration attorney that wrote over five books on immigration. Wifes' IO wanted the days outside of the country since becoming a LPR, but the question doesn't ask that. But she changed it, what the heck, wife still passed. Then others would ignore it all depends on your IO, shouldn't be that way, but that is the way it is.
