Hello,

Does anyone know if I can file for an extension for my wife's AOS. We need a little more time before we file for the green card. She came here on a K-1 and we married inside the 90 days, and now have about 22 days left according to the I-94. A 3 month extension would be great, if it can be petitioned for. Any advice would be helpful. Thanks.

you can file for aos anytime-it doesn't have to be within the I-94 (90 day) expiration limit, people just advise you do so. i haven't yet & i've been here (& married) since mid november. i'm just in limbo lol. hope this helps

You don't need a extension. There is no time limit for AOS and you can file after your I-94 expires. Simply file when you can but it's in your best interest that you do it as soon as you can.

My Immigration Journey:

K1: June 2010 - December 2010

AOS: April 2011 - June 2011

ROC: April 2013 - August 2013

Naturalization: March 2014 - August 2014
