Are we starting too early??

I have been having a dialogue with the U.S. Embassy in Jakarta about this, due to the August 15 changes. They said that I can apply June 20 of this year and they will hold the Visa pending until her 2 year HRR expires in June 2012. I was quite surprised they are willing to do this, but it's amazing what these Embassies will do if you simply ask them.

03/26/2010 - Got married

06/28/2010 - Left for Indonesia

06/29/2010 - Arrived in Jakarta, Indonesia and drove to Tasikmalaya

05/25/2011 - Set up an appointment for my sons registration of overseas birth for June 20th

05/28/2011 - Filled out and printed all documents needed (I think). Didn't sign any of them since some don't need signed until you are told to sign. Neatly organized them in folders.

06/05/2011 - The Embassy advised us that they will "pend" my wife's I-130, so we can file 1 year prior to departure to avoid mailing to Chicago.

06/20/2011 - Filed my wife's I-130 at the Consular in Jakarta (1 year pending from here).

04/09/2012 - Emailed embassy to start I-130 process.

04/10/2012 - Received email to collect documents for IV and call to schedule an interview

04/11/2012 - Scheduled medical exam for June 4, 2012

Timeline

Keep in mind, she may require a new medical and you may have to submit a new AOS if they deem it 'expired' so they probably just won't issue her a visa. It will depend on when the interview is and when the visa is able to be issued

I am trying to get a bit more info from them as to how they will "pend" it. I am asking if they will go through the whole process and just save the interview, as I don't think they can do the interview until after her 2 year HRR is complete. It's only at the interview you need the AOS and medical, right?

Timeline

AOS is done at the NVC level.

Medical will be presented at the interview

you can interview before the 2 year HRR is finished, the visa will not be issued until after the HRR has been met - at which time they may require updated information depending on how long it has been since the interview

You can delay the case at NVC by being slow to respond to requested material.
