DS-3053 consent from foreign parent

My wife and daughter were just naturalized and we applied for their passports.

Wife got her passport, but State Dept says we need consent from daughter's father.

They didn't accept my (non-biological dad) consent, it seems.

One of the things we can send back in is:

> (including the child's name and date of birth, as well as the parent's

> identification or a copy of his/her ID) authorizing passport issuance for

> the child."

But the biological dad is a citizen of - and resides in - another country.

He doesn't know any English or Spanish.

If we got consent in the dad's native language, how would we submit

an English translation? And would the State Dept accept the

stamp of a foreign notary?

Anyone fluent in both languages can do the translation to English. Confirm this by checking the USCIS web site. The guidelines are there. The " certification" is simply a statement by the translator indicating the ability to do the work. The English version could be done here & sent to him to sign at the time he signed the other one. Type translations in the search block here on V J to get more info.

The English version would have to signed by the father as well. I would think they would accept the notary from his country because he wouldnt have any other choice. It may be possible to use a notary from the American embassy but I am not sure about that.

The OP is talking about getting U S passports for new citizens I believe. He mentions that the State Department requires this. That is a psrt of the US government. These people may have emmigrated prior to the present requirement for bringing children to the USA.

Yes, my wife got that permission (an official Ukrainian document) too in exchange for waiving child support. And I entertained translating that document from Ukrainian to English and submitting that. But the permission is about 4 years old. Altho' it does not expire for Ukraine, the State Dept doesn't accept consent that's more than 90 days old.

@Ning - I'm aware of USCIS rules regarding translation. But I find myself not so convinced that the State Dept has the same rules as USCIS...?

I copied this from the NVC site which is a part of the Dept of State as you may know.

Translation Requirements

All documents not written in English, or in the official language of the country in which application for a visa is being made, must be accompanied by certified translations and submitted to the NVC. The translation must include a statement signed by the translator stating that the:

•Translation is accurate, and

•Translator is competent to translate.

When my sister went to apply a passport for her son, she wrote a statement why he wasnt there and was not able to sign the DS-3053 since he is in Africa. She had tried to call him several times and even sent some family members to his residence but he was not available. She stated all this on DS-3053 and even included the phone numbers she tried to call him on and his last known address, had the DS-3053 notorized and a passport was issued for her son without any problems.

It seems he enjoys making my wife's life miserable. He's putting

up quite a fuss and I'm guessing there's about a 50/50 chance that

he'll cooperate and sign a DS-3053 (give consent).

I've also contacted the State Department today and they recommended that

he go to the U.S. Embassy (Kiev) to fill out the DS-3035 and have it

notarized there. Then ask them (the embassy) if they'll translate

it into English. (They might not, I gather?) The odds of the

biological dad going to this kind of effort (overnight train ride

to Kyiv) is nearly nil. I asked if he could just get it notarized

in his town of residence. The State Dept rep said that it's up to

the folks who process the passport application to decide if that's

acceptable or not.

Hi..did u get the passport for ur baby.I'm in same situation.My husband is sending ds-3053 notarized in India.It will english.Would like to know if it will cause any problems in processing?
