K1 and DV lottery

Hi,

I have a question: what happens if a K1 visa holder wins the DV lottery? Would the subsequent AOS be upgraded to a full 10 years green card if called for an interview in US soil? This is just a very remote possibility but since on July 15th there's gonna be a new extraction,It made me wonder about which would be the possibilities that a win would eventually bring to someone in this situation. You cannot hold two visas. So I would think that if you won the lottery after your K1 was issued, you'd no longer be elligible. If you won before your K1 interview, you could chose which way to proceed.

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

I see.So what counts is the status of the person in the moment he/she wins the lottery and not when he sends the documentation to KCC,right? Cause then I wonder how people have the option to apply also in the US...if they're in the US It means they already have a visa no?

Hrmm.... that is a good point. I know if you are over there on a tourist visa at the time of winning the lottery, you can AOS. So I suppose it is possible that if you are already in the USA with your K1, but have not yet filed for AOS (and are legal, ie within your 90 days of arrival), you could maybe chose the DV loterry AOS and thus get the ten year card.
