I'm not anyone's dependent... but is there anything we can do at this point? My dad is the ONLY one in my whole family who's willing to help us out. And his income is, according to USCIS's own guidelines, more than enough! Has anyone else had this happen???

If you are not dependant have you been filing your own taxes? The you need to include your income plus your dads income as joint sponsor.

From what you have said so far it seems your dad is sponsoring your husband and you have put his income as 19k but you have not inculded your income $0.0 you add up it takes you to 19K for 3 ppl which will not meet the poverty line.

So pushbrk...This thread has me confused..If the petitioner and the co sponsor live in the same household they can combine their incomes? If they live separate then the Co sponsor has to make enough for all people involved, Petitioner, beneficiary and co sponsor (self)? so 3 people?

THanks for clearing this up!

Things are different for "joint sponsors" in spouse cases than for "co-sponsors" in K visa cases. For a K visa case there is no combining of income regardless of circumstances. Different animals. Any sponsor counts their own household size plus any previously sponsored immigrants, plus any currently sponsored intending immigrants. ("Co-sponsor" is an incorrect term but a useful tool. For K visa cases the petitioner provides an affidavit of support and if not qualified, most Consulates will consider an additional QUALIFIED sponsor as well. Some will not. Some will sometimes.)

In CR1 and IR1 or other "immigrant visa cases", joint sponsors are allowed. What they are required to provide and whether incomes can be combined depends on circumstances and so must be considered on a case by case basis.

She and her Dad are not part of the same household, so cannot combine income.
