HI,

I have one i864 filled for myself but do my father and mother also fill i864 or i864a ?

We live in the same household. and if they have to fill i864 then how do i add their income in my i864 as in the form " 24. My current annual household income b " i will have to add my parents income and under " 24 d " i need to select The persons listed above have completed Form I-864A.

They only need to fill out the form if you do not meet the income requirements alone. If you are 125% above the poverty line, in their house or not, only you need to fill the AOS.

The I-864 is for you and the I-874a is for a joint/co supporter. If you intact need them to meet poverty guidelines, have them complete their AOS form and simply fill in the needed info on your AOS.

I have filled i864 but my income doesn't meet the requirement so my father who lives in the same household will be the co/joint-sponsor filling i864A

but problem is that my father has 2 dependent and filing tax jointly with my mother.

So the question from form i864 pg # 3

Part 5. Sponsor's household size

question 21 Your Household Size

g. OPTIONAL: If you have siblings, parents, or adult children with

the same principal residence who are combining their income

with yours by submitting Form I-864A, enter the number here.

How many numbers should i put in ?

One because I have only one joint sponsor who is my father ?

Or Three because the joint sponsor (my father) has 2 Dependant ?

Or four because he's filing tax jointly with my mother and coz of 2 Dependant ?

Do you live with your parents?

Is it their home?

Do your parents claim you as a dependent on their taxes?

Using both Mom and Dad's tax info or just Dad's or just Mom's?

Do they file a joint return?

If the answer is yes to any of these, you will need to do two, I-864's. NOT I-864A!

You live under your parents roof, it's their household and you would need to make sure you have filled out the correct amount for who's household it is.

So, On your return if I got your household correctly. You should have two people. Yourself and the intending immigrant you are sponsoring.

On your Dad's, Himself, your mother (spouse), you (any siblings or whoever he claims on his return) and the intending immigrant.

Yes, you BOTH will fill out i-864. This is so that the correct household number is figured in with the actual person's household if that makes sense. I am in the same boat as you. I am a student, do not make enough to sponsor solo, so I am ONLY my father's income as the only joint sponsor. My parents file a joint return. This is why I asked are you using both parents or just a parent as a sponsor. You will need corresponding W2's to break apart the income so they can see the true income of the parent that is the joint sponsor. In your case...Dad.

Dad's I-864 will have, himself, Mom, Both Dependants and the intending immigrant= 5

Make sure when you fill out Dad's I-864 you check the box, I am the ONLY joint sponsor.

Well but this forms are confusing.

Do i need to send both my parents IRS and W-2s for my dad's i864 ?

LOL.

This is what I am sending.

My Tax Return Transcripts that I ordered from the IRS and the corresponding W-2's.

Both Mom and Dad's Tax Return Transcripts from the IRS and both parents corresponding W-2's.

This is so they can see that 1. Dad is the only joint sponsor 2. How much Dad makes himself and how much Mom makes so they can separate the two.

You can order tax return transcripts free of charge for the past 3 tax years 2008-2010 from the IRS. I ordered mine online, got them in my mailbox in 4 business days.
