Hi everyone,

my friend's conditional green card expires next year. Her and the hubby are pcsd overseas for 3 yrs. Can she apply for a petition to remove condition while overseas? sorry for the question.

Yes, she needs proof of being PCSd She has to have her name on the orders not just his name.

They would file to either VSC or CSC depending on where they used to live in the USA.

On the top first page you have to put a notation "ACTIVE DUTY MILITARY SPOUSE OVERSEAS" and include the proof of orders with her name and his name on it.

Even tho they are military residing overseas they have to include the biometric fee with the application. Im unsure as to if they have to supply a finger print card or not tho.

AOS was approved in 2 months and 8 days without interview.

ROC was approved in 3 months and 2 days without interview.
