Hello Every,

We send all the AOS documents for my brother case. My MOM is the petitioner and she completed the I-864 and we live together, so I completed I-864A and send to NVC with all required documents. Few days ago NVC send us Ref and asking me to fill i-864 as joint5 sponser. I am confuse to see why NVC want me to fill I-864 now.

I would assume because she is combining your income with hers. She you may have to co sponser as well then. I would call the NVC and double check to see why exactly. My dad and myself are planning on living togther soon just so we can combine incomes to get my husband over, i automatically assumed he'd also have to fill out the 1-864. I could be wrong! but check into it if you are so unsure because i am not 100 percent sure myself! Good luck :)

You would also have needed to submit proof that you are a qualifying relative, and proof that you live in the same home. Did you provide this proof? Did you check box 8.C on the I-864A, and then check the box that says "Son or daughter"? Are you at least 18 years old?

12/15/2009 - K1 Visa Interview - APPROVED!

12/29/2009 - Married in Oakland, CA!

08/18/2010 - AOS Interview - APPROVED!

05/01/2013 - Removal of Conditions - APPROVED!

Yes we live in same house and I am over 18. My mom doesnt work due to health issues. I also check 8-c. I am not sure why they asking forI-864. but anyways will submint as they requested.

With Mom not working then you are supplying all of the income for the affidavit of support. In this situation is common for the joint sponsor to be required to file an I-864 rather than the form I-864A.

In many of these instances the joint sponsor is in fact the head of the household. This "cleans up" your household count and gives a clearer picture to the adjudicating officer.
