hey all, i have more questions about our affidavit of support. my interview is coming up soon, may 16 in manila. i really wish someone could help us!

a)since my fiance is self employed, does that mean i only have to bring tax transcript? i wouldnt need w2s, paystubs, and employer letter, right?

b) my bigger problem is that my fiance filed for a tax extension for 2010. i already have transcripts for 2008 and 2009. for 2010 i have a copy of his 1099, an extension form, and a letter explaining why he had to file for an extension. am i missing something? for all three years we are comfortably above the poverty line. i hope we do not run into problems :(

c) should i ask for his paychecks for 2010 to substantiate his income?

Self employed people don't have W2 forms or an employer letter. He did not "have to" file an extension. IMO, that was a poor choice for somebody in an immigration process but the extension might be OK. The key will be the income that shows on the tax returns.

Facts are cheap...knowing how to use them is precious...

Self employed people don't have W2 forms or an employer letter. He did not "have to" file an extension. IMO, that was a poor choice for somebody in an immigration process but the extension might be OK. The key will be the income that shows on the tax returns.

do you think I should still include copies of his cashed checks? i have read that some people who filed their extensions brought in their w2s and paystubs and whatnot. i was wondering if i could include his checks, that would be quite similar wouldnt it.

Please report back how this goes as I am in a similar position. FWIW- cashed checks(I assume distributions) being self-employed is not the same thing as a W2 check. But I am very curious to see your results as I am self-employed this year... but was W2 last year. I am assuming "distribution checks" isn't going to do the trick (even though mine will be well over $100k). I am anticipating that I will need about $70k in the bank by the time my financial info is requested (toward the end of this year). Of course if the process takes a long time and my fiance's interview isn't until Jan 2012 than there won't be a potential problem as I will do my taxes asap at the beginning of next year. Of course I'd prefer it all be done before the end of the year though so I'll do everything possible to show $70k in the bank if needed. Please report your results after interview.

If that number or a similar number is shown as "total income" on both the tax transcripts and on the extension he filed, I expect there will be no problem. For the self employed, it is the tax return "total income" that is used as "verification".
