ROC waiver interview done. Questions!

Hey Vj'ers,

I went to my waiver interview this morning as scheduled and it went ok, I think. The IO was very serious, just asking questions. A lot of questions she asked where about the marriage and the events that led to the divorce.

I was told I would receive a decision in the mail after they review my file.

After the interview, she took mt expired permanent resident card (green card) and my passport was stamped with a 90-day I-551 stamp. Does this mean I am approved?

No. It means you have a 90 day extension while they consider your case.

I got the approval letter today, dated 05/11/11.

I went all by myself. I hired an attorney to file my ROC but he didn't me tell what I needed to include in my package. I gave my paperwork(3 bank statements, 2-3 utility bills, a couple of car registrations). The attorney didn't mention that this wasn't enough. Took my money and mailed the package. A couple months later, I received RFE.

I registered on Visa journey and got all the info I needed to respond with the RFE. My package was almost 2 pounds. Mailed the RFE response then got the interview letter.

At the interview, an attorney cannot answer questions for you; so I decided to go all by myself. By the way, my attorney wanted $500 to go with me. So I said no thanks!!

I had made copies of the package and took all originals with me. Officer grilled me but I explained situation and will all the paperwork I sent, I think it helped my case.

I got a stamp on my passport and told me they will mail me a decision. Hardly 2 weeks later, I got my approval letter!!

I am really glad that step is over and now I have started my naturalization journey.

Quick question, because I am a divorcee, do I have to wait till I am a resident for 5 years before I can file an N400. I think the 3 years are for those that are still married. Right?

Yes, you have to be a permanent resident for 5 years before you can file for citizenship. The N400 application can be sent 90 days before your 5 year anniversary.

Only married couples have the advantage of filing within 3 years.

Karibu--thanks and good luck to yours. One thing I will advise you--if you have all your proof of a bonafide marriage and your confidence..you don't have to worry! You will be a bit nervous which is more than okay, but be confident and you will forget the rest!!
