My fiancee's mother applied for an immigrant visa (including their whole family) for Australia 2 years ago. Now I was trying to apply for a K1 Visa for my fiancee when her family's visa application (going to Australia as immigrants) had been accepted and they just finished doing their medical a couple of days ago. Now I haven't submitted my petition for my fiancee yet, but...

if I were to push through, would this have any negative effect on her family's petition?

should we pull her out of her family's petition while it hasn't been approved yet? it's been "accepted" but it hasn't been approved yet, although they have already spent money on her and money's hard to come by for the middle class in the Philippines. would a last minute pull out have any negative effect on her family's petition compared to an early pull out?

(additional info: she was originally not supposed to be in her family's petition but since they have fought hard for her to be in it, she got accepted. If they pull her out of their petition, I'm afraid it might damage her family's credibility. I'm afraid the immigration might judge her family's character, from experience, I think impression's a huge factor when applying for Visas. My fiance lives in Philippines by the way and so does her family. I originally wanted to pull her out of their petition and just have her wait in the P.I. for our petition but since we're all afraid it would have a negative effect on her family's petition, her family and I have decided to just push through with our petition (K-1), and not pull her out of their Visa application until our petition gets approved)

what about if they fly into Australia before our petition gets approved, since my petition would have to be addressed to her Philippine home address, would it be alright if she comes back to the Philippines to follow up on our petition? or would I have to file a whole new petition once she arrives in Australia as an immigrant?

would her immigrant status in Australia have any negative effect in our petition?

please let me know what other possible scenarios might happen (both good, and bad) if she were to stay in the Philippines to wait for my petition or proceed with her family

and last but not the least, we're planning to use her uncle's shop for a mailing address since they might leave before our petition gets accepted leaving their house to be empty, how do we do this? the form I-129f doesn't specify anything about a mailing address and neither does the other form that contains her bio I'm assuming they're going to use the most current home address that we put in the petition to send her the notice of acceptance/approval?

I know your staying up late (past 1:30 Am) to get a answer or advice on this. Something don't sound right due to the fact you wish to Marry over time . But, I would hold steady and wait for other MORE QUALIFIED Members to give you a "Best" Scenerio to posible Outcomes that can and/or Affect a A K-1 Application. Be patient and wait for replies tomarrow. My Only advice is Wait and see what other Members think. I read your Post several times. I admit it past me. I'd rather give No advice in this situation but ask you to wait for elder Members to Comment.

Just bumping my post for other people to notice.

Thanks for the reply, I can assure you that we're a legit couple, I met her through Friendster back in 2005 but we didn't really start noticing each other until 2006, and then I met up with her personally that same year. I could go on with our whole story, but it would take a while to write it down and I don't really want to put people to sleep by putting up an extremely long post here. Although, if you need me to, then I wouldn't say no.

I'm eager to marry my fiancee because it's the only thing I've ever wanted to do from the day we met and now that it's possible, I'm just trying to do my best to make it happen as soon as possible. This isn't exactly something I rushed into.

I don;t think the Australian visa app will have a negative effect- if the US even knows about it, which is doubtful (unless they move there before the K1 interview). What effect pulling out would have for the Australian visas for the rest of the family I have no idea.

Changing address to Australia, and interviewing there (which will likely be neccessary, unless the Aussie visa process takes longer than a year), should not be a major problem either, you just notify the agency the fiance visa petition/ application is at the time.

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.
