From what I've read, CSC used to send RFEs asking for the beneficiary's birth certificate. However, nowhere in the instructions to file I-129 you'll find such requirement.

I only offer advice - not even legal. Just the plain and simple kind.

I (the USC) only included MY birth certificate in the original submission. I'm sure hoping that's correct! :P

My fiance is having trouble getting a copy of her birth certificate and may take her up to 2 months to get. Do we need it to file I-129 or is it needed when the paclet goes to the consolate in Manila? Thanks in advance!!

captive_audience,

As Mew states it used to be considered prudent to include the beneficiary's birth certificate with the petition, but I haven't seen reports of RFEs for it for quite some time.

I do suggest that you use I-129f, not I-129.

My fiance is having trouble getting a copy of her birth certificate and may take her up to 2 months to get. Do we need it to file I-129 or is it needed when the packet goes to the consolate in Manila? Thanks in advance!!

I think the I-129F requires a passport or BC, so you are going to need at least one of those. Since she will need a BC to get a passport anyway if she doesn't have one, you're kind of screwed until you get the BC.

I suggest getting everything else ready now. Then when she gets the BC you are ready to roll!

Gary: please read the above posts. The filing of the I-129F does not require the beneficiary's birth certificate. She still has plenty of time to secure the document.

The birth certificate is needed at the time of packet 3, only the US Citizen's is required to be sent with the I-129F package to USCIS.

Well, we obviously haven't be approved yet, but I didn't send Craig's BC or Passport along with the original submission. I was under the impression that the I-129f submission needed to prove the USCs citizenship, not the alien fiance?

There is no requirement for the beneficiaries passport or birth certificate when filing the I-129F however both will be needed at the consular interview in Manila. The BC must be a NSO copy on NSO security paper. it can be ordered online at:

https://www.ecensus.com.ph/Secure/frmIndex.asp

Also you can go to the embassy in Manila's website and download the contents of package 3 to learn more of whats involved. ( I cant find the link directly to the download but the information is here somewhere)

I am from the Philippines, and I experienced how slow NSO is. just get a copy of her birth certificate before filing I-129F, just to make sure, even if it is not needed in the I-129F package to be sent.on her interview, it is one of the most important documents that will be asked from her.i read some interview experience that they even re-scheduled 2x the interview just because of the birth certificate.

November 13,2006- Called NVC and gave me our case number

November 14,2006- NVC forwarded case to Manila Embassy

November 22,2006- US Embassy Manila recieved my case, and said wait till 1-6 months for the interview date

Feb 2007-interview approved

March 1'07- Visa delivered

April 3'07-Las Vegas, Nevada

April 15'07- Orlando, Florida

April 20- Wedding

April 23'07- France

June 5'07- Back to Florida and file for AOS

"captive_audience",

Hi.... Lorna my wife had a horrible time getting BC on NSO paper which is required for passport and visa.

Here is the basics....

She had to go from Cebu back to her little island Basilian because she never had a BC. This is because she was born in her moms house and her aunt was the mid wife. They never registered her.

When she went to NSO to get her BC, they said she wasn't in the data base.

Then they told her she needed to go back to her original place of birth to Civil registry and start the BC process.

So she went back and ended up staying there for 2 months waiting for an expedited BC on NSO paper that Civil Reg there was supposed to get for her.

Well before that she had to go to cit hall and back to civil reg and get different forms filled out and a witness had to come with her to swear she was born, hehehe.

What a headache. and then after the 10 business days of waiting for the original BC, she went in and it turns out that the mayor there was murdered and it would be another 7 to 10 days. So after the next 10 days she went in and there was nothing. so then she went in every 2 days for about 10 days. Finally I told her to get the tracking number of the doc which they had sent to Zamboanga.

Well now they say they lost the tracking number! Jeeesh! So the lady gave her a handwritten letter so Lorna could go to Zamboanga CR and talk to them.

once in Zamboanga, the CR there finally handed here her a brand new original BC and told her she would send a copy to NSO and request a cert. copy on NSO paper.

Well after waiting for that for a couple of weeks, she needed to get back to Cebu cuz I was flying in to marry her. (Marriage application.... another nightmare!)

So she left and we got married in Cebu and then when we tried to order her BC from NSO through Ecensus website, it came up negative. back then.....in may... and, just last week.

So the way we got our BC on NSO paper quickly was a guy at Civil Reg in Cebu who did our marriage application and cert. said he could get the BC cert on nso paper quickly cuz he had a friend who worked at NSO.

Well we got it in 2 days.... after giving this guy 10.00 for his friend and tipping him 5.00.

So the whole idea to this story is....

Start your BC process right away cuz you don't know how long it will really take to get the new original from CR. And NSO is extremely slow at getting the cert. into their data base.

And that you can pay someone "under the table" to get it done quickly.

Sorry for the long post but it was such a nightmare for us. Maybe this info will help you avoid some of the problems we had.

Mike
