Filing Income Tax when married to USC

Fellow Canadians..... Need help.

When I file taxes in January, I assume since I'm married now, even though he is a USC, I need to file as married. I know in the US they can file as Married-Filing jointly or Married-Filing Seperately. Does the same apply to Canada?

I've always done my own taxes in Canada, so I don't have an accountant. Is this going to get complicated enough that I need an accountant?

Who's filed & how did you do it ?

Here is the website for the Canada Revenue Agency. You should be able to find the information you are seeking on this website. If that doesn't help, then in the blue pages of the telephone directory look for Canada Revenue Agency and under them 'Problem Resolution Office'. It is a 1-800 number but you will be able to leave a message. Someone there will look up the information and get back to you with what you need to know to file Canadian income taxes while married to a US citizen but still residing in Canada. Good luck. I know the answer if you were a K-1 moving to the states but not for a CR1 or K-3 outside of the States.

lets see if I remember correctly...

I filed as married but then I wasn't sure what to put for the SSN number that they required for my hubby so I called and the person said to put NON-RES (short for non-resident) in the space provided for the SSN.... the only thing is that I couldn't e-file my tax return because it wouldn't accept the NON-RES thing so I had to print it out and mail it.... but I got my tax refund with no problems....

i think I also included a letter explaining the situation too...

Ditto what marilyn stated!! Pretty much what your doing is filing as if your single, even though you stated your married. I assume ur spouse is residing in the USA. If thats the case, she isnt entitled to any Canadian income tax deductions, at leats thats what i was told a few yrs back when I called Revenue Canada!

Canadians Visiting the USA while undergoing the visa process, my free advice:

1) Always tell the TRUTH. never lie to the POE officer

2) Be confident in ur replies

3) keep ur response short and to the point, don't tell ur life story!!

4) look the POE officer in the eye when speaking to them. They are looking for people lieing and have been trained to find them!

5) Pack light! No job resumes with you

6) Bring ties to Canada (letter from employer when ur expected back at work, lease, etc etc)

7) Always be polite, being rude isn't going to get ya anywhere, and could make things worse!!

8) Have a plan in case u do get denied (be polite) It wont harm ur visa application if ur denied,that is if ur polite and didn't lie! Refer to #1

yeah, you still need to put on the forms that you are married but you don't need to include the non-res spouse's income etc...

I was using a computer program, so to ensure my spouse didnt get any Canadian deductions, I converted her US salary into Cdn $$$.
