Here is the scenario:

-Found out the ex-wife is seeing someone else Jan of 2009. Tried to work it out, but to no avail.

-Oct 2009 the ex-wife moves out.

-Apr 2010 I tell my ex-wife I am filing for divorce

-May 2010 I meet my Fiancee and have on going relationship

-Jul 2010 I file the divorce papers

-Oct 2010 I visit her and spent 3 weeks w/ her and we got engaged

-Mar 23,2011 the divorce is final

-April 1, 2011, I filed the I-129F, CSC, (in review status)

I have read a post by someone who got their Visa denied because the CO said you cannot be married and engaged at the same time.

I believe the beneficiary was from Colombia. Is this a standard operating procedure for CO's or does it depend on the beneficiary's country?

Any insight is appreciated. I just can't believe you would be denied for that reason even though you've been separated.:help:

You ain't married, as your divorce is final, and your marriage is indispuably over as of 2011/03/23 (and you filed after that date).

If your Legally divorced and have a signed and Courthouse Seal documenting you are free to Marry and petitioned AFTER the Divorce. You should be fine. Lets see what others think ?

back in year 1999 i was going thru divorce for 8 months, during that time i went to china, got engaged and 3 days after divorce final, filed for k1. It was approved no problem. I think it will be ok.

Visa K1 Journey

02-21-10 met online

04-13-10 visit for 21 days in Philippines

08-14-10 visit for 3 months in Philippines

11-01-10 filed K-1

11-06-10 NOA1 received

04-19-11 RFE received

04-21-11 RFE returned

05-04-11 NOA2

05-11-11 Received at NVC, case number assigned

05-13-11 Left NVC to the USEM

06-01-11 Set up interview with embassy

07-21-11 Approved!... with an additional document she needs to aquire.

You shouldn't have any problems because of the date your divorce was made final, it should be fine. Shawn filed the I-129F about 3 months after my divorce was made final, we'd been together longer than that obviously but my ex and I were separated long before I even filed for the divorce. It was never mentioned at my interview, I gave them the divorce decree and that was that. Good luck with your process! :thumbs:

The question that matters is:

Exwife US citizen or did you apply visa for exwife? If exwife US citizen you have a minor red flag on case that you will need to explain but shouldn't be a major problem.

If Exwife not US citizen and you brought her here on a K1 or CR1 visa, then you have a nightmare scenario ahead of you.

My ex-wife is a USC. We were married for 22 years. I did not bring her to the US with a K-1 Visa.

The question that matters is:

Exwife US citizen or did you apply visa for exwife? If exwife US citizen you have a minor red flag on case that you will need to explain but shouldn't be a major problem.
