hello, i have a 3 year old daughter (IR2 category), will she be needing an Affidavit of Support? my husband (he's the biological dad) (US Citizen) is in the States for almost a year now. I filed for CRBA she was denied (I knew she would be, but the embassy will ask for it so we went and paid anyways), I was reading at the NVC webpage and i came across this

Effective immediately, an I-864 will not/not be required for the following categories of immigrants:

© a child classified IR-2 who was born (in or out of wedlock) to a parent who is now a U.S. Citizen, provided the child will be admitted to the U.S. while still under age 18 and will reside in the United States with, and in the custody of, the U.S. Citizen parent;

anyone who can shed some light? thanks in advance

I130 sent : July 27, 2010

NOA1 Received : August 16, 2010

NOA2 Received : March 11, 2011 (207 days from NOA1)

NVC Journey :

NVC received : March 18, 2011

DS3032 emailed : March 30, 2011

AOS fee received : March 30, 2011

Visa : April 1, 2011

Paid AOS and Visa via Mail : April 4,2011

I864 sent : (by the petitioner) April 13, 2011 (overnight)

DS230 sent : (by me) April 11, 2011 NVC received April 13,2011

AOS RFE :(co-sponsor proof of citizenship) : April 23,2011

RFE sent : April 25, 2011 (overnight)

DS230 RFE : April 26, 2011

RFE sent : April 28, 2011 (via FedEx) NVC received May 2, 2011

INTERVIEW RESULT : APPROVED!!!! :)

Is this new? My USC husband filed an I-130 petition for my 8 and 12 yr.old kids that time(last year) and were granted an IR2 visa. Each of my kids had a separate I-864.

Why is ur CRBA denied? Is the child's bilogical father a USC by birth or did he meet the residency requierments?

Just curious why CRBA was denied.

coz,my husband didn't met the residency req's. but he is the biological father.

You will need I-864W, since the biological dad is USC. Your child will be USC as a derivative of the father when she comes here.

Ah ok..that's what i was thinking that he did not meet the residency requirement. Your child can still apply for US citiznship once u become a citizen.

Ezzie is correct. File for I-864w.

already did. . .actually got an RFE for that they actually requested I864W for my daughter. anyway, over and done with just counting the days till the interview. . . :)
