I have a few questions regarding the I-134. Our I-129 for K-1 was approved already and at the moment my fiancee is waiting on packet 3 to arrive in Cambodia. The only thing I am scared about is my employment or lack of employment for the past 2 years. I've been bouncing from job to job through temporary job services and was (as of January 7th) a lay off from my 3 month long job. I've had a rough 2 years as far as employment goes.

The thing is, now I'm collecting unemployment money from the state at only $268 a week, my 2010 tax return sais I made $13,000 last year. Ok now for more of my situation..I just got a part time (20 hours per week at $14.00 per hour) job but my first paycheck won't come until the end of April since it's paid once a month. Also, I live with my fiancees (the beneficiary's) aunt and uncle and have been living here for a year and a half, they treat me like family and are helping me by not making me pay full rent until I find full-time employment. I currently have $2,100 on deposit in my savings and it will remain on deposit in case I need to deposit a bond of some sort...

I will have my fiancees aunt and uncle (not the same aunt and uncle that I live with) help provide as the co-sponsor. Their 3 year income has been 2008- $48,000, 2009- $38,100, and 2010- $49,000, they will do the I-134 as well as submitting letter from employer, 3 year taxes, and a statement saying they will help with food, living, money or any other situation that may occur in an emergency.

Now for my questions

Does my situation look bad?

Do I need to submit my unemployment info (since I cannot provide my latest paystubs)?

Should I include a letter from the aunt and uncle in which I live with? saying; I currently live with them and this is where my fiancee will live when she arrives, also saying she will not require rent being paid until employment is found, she will provide food or anything else that is needed.

I'm just curious because I'm providing my I-134 with a joint sponsor, money in savings, and statements from family members--I don't want to send too much information and I don't want an incomplete when packet 3 is reviewed or to not meet the public charge guidelines......I could go on with more questions but I'll stop for now.

It doesn't hurt to give to much information. Provide all your income information including your unemployment. This being said, you will need a co-sponsor. With 4 dependents the income requirement is around 22,000, someone can correct me if I'm wrong. Also, you will have to provide a letter from your current employer. Please take the time to read the guides and affadavit of support. I current live with my parents but will be living in a connecting apartment and I did not provide a letter or notation about rent. Honestly, your situation is not bad at all especially since the economy has been so bad these last few years.

That's great to know my situation isn't that bad!!! I guess I'll proceed with all of the letters, I don't think they could hurt the case. I'll definitely be back very soon with more questions as we proceed but my brain is overloaded at the moment having to deal with paperwork! I appreciate the quick reply and I wish you luck in your case as well :)

The I-134 does not provide for the combining of incomes. You would need joint sponsor that individually makes enough to cover their own household plus the intending immigrant. This is a numbers game. If a sponsor shows sufficient income/assets then it's a go. If not, it's a stop.

Potential Problem (not accusing you of anything) -->> Relying on the beneficiary's family for sponsorship may cause the CO to wonder if the immigrant is coming for love or just using the petitioner (you in this instance) simply for entry into the US.

The I-134 does not provide for the combining of incomes. You would need joint sponsor that individually makes enough to cover their own household plus the intending immigrant. This is a numbers game. If a sponsor shows sufficient income/assets then it's a go. If not, it's a stop.

Potential Problem (not accusing you of anything) -->> Relying on the beneficiary's family for sponsorship may cause the CO to wonder if the immigrant is coming for love or just using the petitioner (you in this instance) simply for entry into the US.

So if the joint sponsor is married, would I need to provide a separate I-134 for each of them or only use one I-134 for say the one who makes the highest income?? And also would I need to provide an I-134 as well, on top of the joint sponsor's I-134?

I know it's a big red flag in the CO's eyes but really at this point I'm out of option's since I don't meet the $18,000 in the guidelines. You only need one I-134 for your co-sponsor and if they filed jointly they would list spouse on that form. You also need to fill out one I-134. It appears your uncle makes enough to support. So yes you AND your uncle each fill out the form.
