Yes it's another Police Check/Fingerprints question

Sorry to bother you all again but I keep reading and reading and can't see to figure out for sure what we need to do and how much time we are looking at to get this part done.

I am the USC and my husband is the Canadian citizen. He did something stupid as well about 10 years ago. He said that he was arrested and fingerprinted, but they expunged his record after he did some community service. (not sure if this is conditional or absolute or pardon)

I am assuming he needs to get his police check (is this from the local police? or RCMP? I keep reading that some people did one and some did the other)

I am also assuming he needs fingerprints too. Again, RCMP or local? And how long does it take to get the prints back?

Finally, court records??? Is this necessary as well? or just the clean police report and fingerprints??

If you know any of this, can you please help??

When I did my police check (since I knew I had no record) I did not have to do any fingerprinting. I think if something comes up, you may have to go to the local police office to do fingerprints, etc., but that's where most people start. Hope that helps?!??!

Not sure about what record you need from Canada or finger prints. He should disclose his arrest though even if the record was expunged. Simply list it on the form and the results (CS and expungement). Many people have had small run-ins with the law from time to time and don't experience any issues. What the government is looking for are serious infractions of the law and/or a pattern of law breaking. Good luck.

Yes we definitely plan to declare it when the time comes, but as we prepare for NVC I am nervous that we'll forget we need certain things, and delay our application by months. I am pretty confident about everything else in the process, but this part makes me nervous. Thanks!

If you've ever been convicted of a crime, he'll have to get his fingerprints done. (I did mine thru my local RCMP and it took a lil over 2 months) but I'm positive they can be gotten quicker. US immigration does not recognize expugements from Canada so he'll need certified court docs. Depending on his crime, he may or may not be asked to file a waiver at the time of his interview.

Does he just go to the courthouse for these? Is there a fee associated or a wait?

I had to go to the courthouse and "order" mine, there was no fee involved when I got them, actually the woman that was the supervisor of records went waaaaaaaay above and beyond for me, she wrote a letter (along with my certified court docs) that explained the subsection of the Canadian Criminal Code that I had been charged with.
