Timeline

Hi everyone,

I have been married to my wife for nearly 5 years, and have had my green card for just over 3 years. I am eligible to apply for citizenship at this point, but we are getting divorced.

If we get divorced before 5 years (in CA at least), it's a lot cheaper. This means we need to file before May. My question is whether I should file for citizenship before that. If it takes a few months to get the interview, then we will be mid divorce by then, so would the case get thrown out? Or is it a case of 'as long as you are married when you file, then you're good'?

I don't really want to waste all that money if I can help it!

08/01/05 - received NOA 1

10/28/05 - received NOA 2

11/17/05 - received packet 3

11/18/05 - booked medical

11/24/05 - sent in Packet 3, happy thanksgiving!

11/26/05 - medical in birmingham

11/27/05 - embassy received packet 3 via recorded delivery

11/30/05 - received medical back from birmingham

12/19/05 - got police cert back - 40 days exactly!

12/22/05 - emailed embassy to hassle them for an interview date

12/29/05 - they emailed me back saying interview will be on Feb 1st

12/30/05 - packet 4 received in mail

02/01/06 - interview - APPROVED

03/09/06 - fly out to san fransisco

05/13/06 - Married!!

12/23/06 - Sent AOS

02/08/07 - Fingerprints

03/06/07 - More fingerprints!

04/27/07 - Emploment Authorisation Card arrives!!

04/30/07 - Interview date arrives

05/01/07 - Applied for social security number at SS office

05/30/07 - AOS interview

if you are getting a divorce now, then you can't file until you have been a LPR for 5 years. You have to be married all the way, until you get your Naturalization Certificate at the Oath Ceremony. After that you can divorce.

10/01/2010: Application was sent.

10/04/2010: Application was received.

10/06/2010: Email received "Application has been received" & Noticed Date.

10/07/2010: "Touch"

10/08/2010: "Touch" & Check was Cashed

10/09/2010: NOA1 Received via mail.

10/22/2010: Status Changed Online "Request for evidence" It was for Biometrics.

10/25/2010: Request for evidence recieved "Biometrics Notice".

11/18/2010: Biometrics date ==> 11:00AM. Biometrics was taken On time.

12/03/2010: "Yellow Letter" Received.

12/06/2010: "Touch" Case Moved to "Testing and Interview".

12/08/2010: Interview Letter received via mail.

01/13/2011: Interview Date. Done, " Thanks To ALLAH, I Passed the Test.

01/18/2011: Oath Letter was Sent.

01/20/2011: Oath Letter Recieved via mail.

01/28/2011: Oath Date. ==> Done, I am a U.S. Citizen

01/31/2011: Applied for a U.S. Passport Book, And, U.S. Passport Card.

02/25/2011: Passport Book's Received.

02/26/2011: Passport Card's Received.

02/28/2011: Certificate Of Naturalization's Returned.

Game Over.

Timeline

If you file in the bases of marriage (3 year rule) you will have questions asked at the interview about your existing marriage. So yes if you are divorcing or have divorced that will not work. Wait 2 more years.
