Hi....

I am a US citizen. I would like to file for my parents who already have multiple entry visiting visa for 10 yrs. Now they r in India.From the USCIS website i understand that my birth certificate is enough to file for my mother,but need their marriage certificate for my father. Now the problem is that they dont 've a marriage certificate. They got married in 1972.What are the other options if we dont have a marriage certificate to file I-130 for parents.

The documents we have 1.passports

2.Indian election ID

3.Ration card

4.Fathers service pension documents

All the above mentioned documents proves that they r husband and wife.

My question is that is the notary affidavit stating that they are married based on the above documents enough for I-130 filing???????

You can still petition for your father even without a marriage certificate. Just increases the changes to gather more evidence ie. DNA test.

They can request a marriage certificate from local Magistrates office.

Under the Hindu Marriage Act - they can obtain a marriage certificate based on their marriage in 1972.

Thank u for the quick response.

Can you plz. tell me the procedures if u've any idea...
