So, we got started on the paperwork allready

Now, since I am currently in the country, in order for us to file the paperwork right away, do we also need to file a I 94?

Or would we just wait to file till i get back to my country? (March 28)

You will need your marriage certificate to include in the package before mailing it =) I would probably wait and mail it after. Don't really need an I-94 to file for it.

Yeah haha, i kno. We just started looking at all the paperwork and what all we need to fill in,, lol. Kinda of being a little prepared, around all the other excitement of the wedding! So wait till i'm in BE and than file, works for us.

yes, arrival departure record. I am (Belgian) and currently here in the United States, prepared to marry next week. So me and my soon to be, right now are in US.

While looking at the I 130 question 14: If your relative is currently in the US, arrived as ,, ... so - I 94 ?

We were just trying to figure out if we'd file the paperwork when I'm still in the country, and after or marriage. Or wait and file it when i'm back in BE.

OK so you are filing a Petition for a spouse visa after marriage, and you will be not overstaying your visa, and will be interviewing for the CR-1 spouse visa at the US consulate in your home country. Correct?

You can file the I-130 before or after returning to your home country, it does not matter.

Keep in mind entry on the Visa Waiver program with the intent to stay and immigrate can be very dangerous.

Could mail it the day your dropped off at the airport too lol

We did all the K-1 forms when I was in the US ( no I-94 ) mailed it 2 days before I left and then I went home to Canada. Had no issues without an I-94 or anything like that. (canada/US does not issue I-94s when visiting)
