IR5 for parents while they are here

Hi,everyone. I am a new US citizen now through the marriage. My parents just got their B2 visa and coming to visit me in US next month. My question is : can i file the IR5 for my dad only while they are here? They will back to home country before the B2 expire and attent the IR5 interview at home country?

OR file the IR5 after they back to home country?

Anyone experience this? Thanks a million

04/01/2011 Received I-130 NOA1 for dad

07/18/2011 NOA2

NVC stage

08/31/2011 Case number, emailed DS-3032

09/01/2011 Paid AOS fee $88.00

09/12/2011 Paid IV fee $404

yes you can petition for your parents while they are visiting.. you can do it before your dad gets here. I'm glad that you are doing it the right way...!

Timeline

you can file the 1-130 and the i-485 if they are in the us,....if they are not in the us then file 1-130 only....while thay are here is better.they will get a green card after the aos.

Thanks a lot! I plan to file the IR5 for him after he get here due to the financial reason. I think the time they leave US, they can finish the rest of the IR5 process in home country. I just want to double make sure file IR5 while they are in US will not affect their IR5 process, right? Thanks again! p/s: i dont want to do the AOS since i saw some case got denied, it worry me.

Thanks for suggestion. I saw some case got denied of being intention immigrant. So maybe i will not choose this path. Thanks anyway

hello JKelly07.. You Just became one of our Platinum member in the ast 24 hours congrats .. and I know you know the answer to this what happened here.? Yes the person can file I-130 and I-485 BUT basically that is the applicant LYING to the Immigration Officer when asked WHY are you coming to the USA... Immigration Intent.. It's not advisable .. that's setting them up for failure. Edited by RICARDO4EVA2

It will not affect the process. My mother got approve on IR5 on December 19, 2010 and when she got her SSN she petitioned for my brother on December 27, 2010. There will be no issue to submit the Application while the applicant is here. It's those people who feel they cant be apart that make their cases complex and run to VJ with issues that were controllable. Kudos to you for doing research. good.gif

It will not affect the process. My mother got approve on IR5 on December 19, 2010 and when she got her SSN she petitioned for my brother on December 27, 2010.
