HELLO VY MEMBERS,

MY SITUATION IS THIS. WE ALREADY PAID AOS BILL AND RECEIVE INSTRUCTION FROM NVC TO NOW SUBMIT I864 AND THE SUPPORTING DOCUMENTS.THE PETITIONER, WHO IS MY SON ALREADY HAS HIS W22008 AND W2 2009.mY PROBLEM IS, MY SON DID NOT YET FILE HIS TAXES FOR 2010 WHICH HE SAID HE WILL FILE IT THIS MARCH. MY QUESTION IS;

1.IS IT OKEY IF WE SUBMIT THE I864 NOW TOGETHER WITH HIS W2 FROM 2008 AND 2009 ONLY AND WITHOUT HIS 2010 W2 YET? SINCE HE HAS NOT YET FILED BECOZ TODAT IS ONLY FEBRUARY?

THANK YOU

2010 taxes arent required until 18 April... you will ok with what you got. Also, If he can get transcripts from the IRS, that would be much easier. Otherwise he has to send all w-2s and 1099s with the tax return also. He can submit it with his 2007, 2008, and 2009 info. I would also suggest to send just the w-2s for 2010. That is what I did last year when I hadnt filed my taxes yet.

I agree. The tax transcripts I requested arrived in less than a week. I sent transcripts for 2007, 2008 and 2009 with my I-864 in December and my wife will just bring my W-2 for 2010 to her interview in March.

correct they understand that it's tax time an april 18 is the dead line,after april they will want the 2010 tax return or transcript,for the year you can send the copy of the w2 a few most recent pay stubs, 2008-2009 w2 for 2010, that should work.
