Confused with i-765

Hello just a few questions:

In i-765 form item number 15, I am asked for the "current immigration status", what do you write if your tourist visa expired already, so technically I don't have a status. I am submitting this i-765 or work authorization application along with my AOS as spouse of USC. Also, can I cross out all items which are not relevant to my case just to emphasize that I do not need to answer them. Thanks.


May 24, 2010- non USC arrived on B2

Sept. 2010- USC & non-USC introduced by a friend on FB

Oct. 10, 2010- USC & non-USC met

Oct-Nov 2010- dating, fell in love

Nov. 23, 2010- B2 expired

January 11, 2011- married at Christian Church and living together

March 11, 2011- i-485, i-130 & i-765 filed via USPS(Day 1)

March 14, 2011- Packet received at Chicago Lockbox (Day 3)

March 17, 2011- Email Notifications received from USCIS of their receipt of the packet, and transferring to NBC. (Day 6)

March 17, 2011- Checks cashed by USCIS (Day 6)

March 21, 2011- Received NOA1 (Day 10)

April 4, 2011- Received Biometrics for i-765

April 8, 2011- Plan for Early Walk-In, and inquiry about i-485 biometrics (SUCCESSFUL)

April 22- I-485 Touched, I-130 and I-765 (still initial review status)

April 23- Received Appointment Letter for Green Card Interview set on May 24, 2011 (Wish me Luck!!!)

May 12, 2011- Received EAD Card!!!

May 13, 2011- Will go get SSN

May 19, 2011- Got my SS Card in the Mail :)

May 24, 2011- Interview Date for Green Card (Successful!!! Card Production Ordered)

Waiting for the Green Card!!! :):):)

June 2, 2011- GREEN CARD IS HERE!!!

GOD IS GOOD ALL THE TIME and ALL THE TIME GOD IS GOOD!!!

Type "OOS" = out of status in "current immigration status" blank.


11/8/10: Medical exam

11/12/10:Get married

11/19/10: I-693 sealed.It means my chest x ray is fine :)

11/20/10: Package [ I-130,I-485,I-765] sent to Lockbox

11/22/10 [Day 1]: Delivered there

11/29/10 [Day 7]: Return receipt from USPS

12/13/10 [Day 21]: Texts and email received [ after 21 days!!!!!!!!!!!!!!]

12/16/10 [Day 24]: Snail copy received

12/18/10 [Day 26]: Every single form touched

12/20/10 [Day 28]: Biometrics letter received

1/13/11 [Day 51]: Biometrics done

1/24/11 [Day 62]: Biometrcis appointment received AGAIN.!!!!!!!!!I was like #######

2/04/11 [Day 72]: Second biometrics done

2/15/11 [Day 83]: EAD in production.

2/18/11 [Day 86]: Interview letter received, set for March 21

2/22/11 [Day 90]: EAD mailed out.

2/25/11 [Day 93]: EAD received

3/21/11 [Day 118]: Interview but left with no decision ToT

3/31/11 [Day 128]: RFE regarding police clearance

4/13/11 [Day 141]: RFE sent

4/19/11 [Day 147]: Card in production

4/22/11 [Day 150]: Welcome2USA letter received

It took 5 stressful months exactly.

Also, since I am filing under category © (9) or filing under AOS as spouse of a USC, do I have to attach copy of 1-94? How about identification card like passport bio page, do I also have to attach this to the i-765 fornm? Many thanks everyone! :)

How about the 2 passport photos required? I am asking about these attachments becoz if you are concurrently filing it with i-485, some rules may be different. Thanks again. :)

You need a copy of I-94 [ both front and back], a copy of your whole passport [ I mean all pages] for your I485/I765 package. For more info, please check out the "Guides" above in the VJ website.

Oh, ok, i have that in my 1-485 package. how about the photos? SO do I need two more passport photos in the i-765 in addition to the photo requirement in 1-485 and 1-130?

You need 2 photos for I-485, 2 photos for I-765, 2 photos for I-131, 1 photo for G-325A each. So in total, you need 8 photos for yourself since you have to send 2 G-325A, 1 for I-130 package, the other for I-485&I765 package.

As for your spouse, he/she needs 1 photo for his/her G-325A

Heyou,

Crossing things out that don't apply?! You mean literally put a line through it? If there's anything in any form that you can't answer or you don't have the information for you either write in "N/A" or "none" - but fill out any field so they don't have to send you a RFE about it, question your missing answer - so crossing out is a no no ;)

12/17/2010 - 9.25 a.m. - 9.45 a.m. Biometrics done !!

12/23/2010 - EAD Approved and Card on its way - Email notification received *yay*

01/03/2011 - WOOOHOOO ...EAD Card in Hand!

01/04/2011 - Oh boy....Received Interview Letter today - February 3rd is the day! :)

02/03/2011 - Interview scheduled 12:45 p.m. - out of there before 1:30 p.m. - further review

Coming home, checking for touches at 5:30 p.m. - CARD PRODUCTION ORDERED !!!!

12/12/2012 - NOA 1, status extension received

12/18/2012 - Biometrics appointment letter received

01/08/2013 - Biometrics done
