Timeline

My husband didnt file a tax return for 3 years but we all have now this forms ready to submit to IRS. My visa is expiring in 2 months and we are going to send this Federal tax return for each of the 3 most recent tax year together with my AOS papers. Do you think this will cause a problem? Please help! Thanks!

Your profile shows K-3, that visa typically gets a 2 year I-94, the visa may expire, however your legal status does not until the date noted on the I-94 card.

File the I-485 ASAP, any period of overstay tends to be dropped upon approval of the AOS.

My husband didn't have 3 years of tax return when I applied for AOS either results: we couldn't prove he met the financial qualifications to sponsor me. We had to find a co-sponsor for i-864...

Thanks YuAndDan, yeah we already gathered all the papers for my greencard and will send it next week.

@can702, goodluck to your AOS application. I'm sure we met the poverty guidelines. I'm just concern that filing late on tax return will cause any problem.
