Hi everyone, I'm new to this forum and I am so glad I found it. Anyway, my friend is a US citizen and she is planning to apply for K1 for her Fiance. Now, he is from Cuba and needs to go back home every 11 months in order to retain his residency. The thing is, somebody told my friend that he can only re-enter or re-entry once, coz he is from Cuba. My question is...granting he got approved and get married here then adjusted his status to a non-conditional immigrant, is he allowed to apply for a I-131 (Travel Document) like other immigrants from other country? Any idea will be greatly appreciated :) .

Thanks ang GOD bless!

Legal Permanent Residents are allowed to travel freely. The travel document is a temporary measure for when the immigrant's AOS is pending, during which time they cannot leave the country without abandoning their application. (There are other uses for travel document, but this is the most frequent on this forum).

I am not sure if Cuba adds anything to the mix, but I wouldn't think so.

AOS for my husband
8/17/10: INTERVIEW DAY (day 123) APPROVED!!

ROC:
5/23/12: Sent out package
2/06/13: APPROVED!

To leave the U.S. to visit Cuba until he gets his green card, he needs advance parole, which can be applied for as soon as they get married. When they apply for AOS, they apply for advance parole at the same time.

Once he has his green card, he may enter and exit the U.S. at will. If it is a conditional green card, which is what he will get if they are married for less than 2 years, that will not affect his entry and exit abilities.
