you could file with w7 form if your spouse doesn't have a SSN yet. it is to receive an ITIN...your spouse can can be treated as a U.S. Resident for tax purposes from anywhere in the world so long as he/she declares any worldwide income.

This information is correct.

Based on what I've read, it's completely legal. I would seek advice though on filling out the forms.

I myself have an accountant to do my taxes. It's worth it...filing jointly will most likely get you a refund if you've been deducted all year as a single. I filed single and had an extra $100 every week and I still would owe about $3000 if I didn't file jointly. Now that I am filing jointly, I'm getting back $4000 :D

So does anyone have any experience with having an IRS service center do their taxes? It's FREEEEEE! However, they say that I have to have the ITIN first. The ITIN instructions say that I file the W7 with my tax returns... so which comes first? Chicken or egg?
