I-864 Help

My wife is preparing to send off the I-864 package but she does not have her W2's. She is currently unemployed and did not file a tax return for 2009 but she has written a letter explaining this. Her father is acting as co sponsor and it is only his income that will be taken into account, he has all his W2's. Will we get an RFE as my wife does not have her W2's or will this not matter as it is not her income that ids being considered?

As much evidence as possible for the I-864's is the best. Does your wife have W2's for 2008 or 2007? Or...if your wife is submitting IRS transcripts (these can be obtained for free by calling the IRS number), then she doesn't need to submit the W2's. Your wife's income will be "counted" as well as your father in law's b/c your wife and your f.i.l. will be financially responsible for you

No she does not have any of her W2's, how long does it take for the transcripts to arrive? Do you think we would get an RFE if she just sent her tax returns without the W2's then?

A complete tax return with all supporting documents would be needed if transcripts are not sent. An incomplete return package (missing W2 for example) would likley result in an RFE.

Transcripts arrive within 10 days or so by mail. You can also ask to have them faxed to you and that way you get them within a few hours in most cases.
