counted as household member or not?

hi, i am confused about whether to add my brother or not.

basically i am filing as a primary sponsor who is living and residing at my moms house and combining her income with mine.

i have a younger brother who is considered legally an adult but is special needs his only income is disability by which my mother is the payee.

my mother in times passed has always claimed him on her taxes but i as the sponsor have never claimed him as a dependent so i am confused

am i still required to include him as a household member?

i read the instructions it says under 21 but he is not

and anyone you claim as a dependent but "I" have not only my mom

please if anyone can shed light on this

No need to include him on your I-864, however your mother should include him on her I-864A, or I-864 if she is going to be a joint sponsor.

No need to include him on your I-864, however your mother should include him on her I-864A, or I-864 if she is going to be a joint sponsor.

I was also curious about the same. My father will be a co-sponsor. We will be living in the upstairs apartment of his two unit house.

I'm assuming that despite being in the same structure, and same address/property, the fact that it is a legally separate household(ie: upper unit vs. lower unit), that he would file the I-164 NOT the I-164a. Correct?

We'll be moving into our own residence in a few weeks after arrival anyhow...

02 Nov 2010-Left China to meet this wonderful girl

20 Dec 2010 - Married in Mindanao

03 Jan 2011 - I-130 Filed in Manila, despite missing MC and LB (5 min processing at the US Embassy-no attorney)

15 Jan 2011- I-130 Approved

02 Mar 2011-Visa Interview-Approved

08 Mar 2011-Visa Received with passport!-Plane tickets purchased(looking for apartment!)

*NO ATTORNEY NOR FIXER WAS EVER USED!-THE PROCESS WAS EASY*
