the new 2011 poverty guidlines came out but arent listed for i 864 yet for 125% but there is a $380 increase for a family of 5 for 100% so im sure the 125% will also increase by this................ is that right i was reading on this website?

can any body tell us we file in novemember 2010 so will it also affect us????

http://www.gafnervisalaw.com/2011/01/24/2011-poverty-guidelines-released-i-864-affidavit-of-support-and-i-134-affidavit-of-support/

It doesnt state teh 125% only the 100% jaan...so im guessing that the amount for 125% also went up... it was 25,790 for 100% for family of 5 for 2010

Due to increase in prices on goods, the poverty guidelines that determine what the Petitioner, or Applicant must make as income have increased. This affects all I-864 (affidavits of support).

“This notice provides an update of the Department of Health and Human Services (HHS) poverty guidelines to account for last calendar year’s increase in prices as measured by the Consumer Price Index.” FR Doc. 2011-1237 Filed 01/18/2011 at 4:15 pm; Publication Date: 01/20/2011.

Multiply 1.25 times the 100% level. The new 125% level for a family of 5 is $32712.50.

it is not the income requirements on the date you filed the petition but on the date you submit the Affidavit.. when did you submit the affidavit? If you have not then guess what.... It is now 2011
