pending green card - can i get driver's license?

You will likely need your actual card in your hand to apply for the drivers license.

NY REQUIRES (Green-card, EAD card, or an I-94 card valid 1 year or longer)

NY allows you to use your foreign DL, until you become a permanent resident, then you need to apply for a DL or a Learner's Permit.

This means i can't just get a letter of ineligibility for SSN from a Social security office?

Nope, NY requires Legal Presence Document, before they will issue a DL.

In our case my wife had SSN, and we did not bother trying for a DL until had Green-card.

http://www.dmv.ny.gov/forms/id44.pdf ( Need to be able to total 6 points on this chart, some types of items only are worth 1 point and cannot use others of same type. ) You can see what I mean. a NON-Immigrant will have a very hard time satisfying NY DMV requirements without first becoming a Lawful Permanent Resident (Green-Card holder)
