I-864 when to file

RogerandMai- If you are filing for CR1/IR1 visa then no. The I-864 doesn't come in to play until after USCIS has approved your petition and your case is sent to the NVC.

If you haven't read the LingChe guide yet, I suggest you give it a glance. There are some helpful hints in there :) Good luck with the rest of your journey!

yer local office is HCMC ? you are DCF case in Vietnam?

if YES -

then no - you not file the I-864 with the I-130 to HCMC - you will file the I-864 and DS-230 together, to HCMC, AFTER HCMC has approved the I-130 petition.

(if none of this makes sense, that's ok - just disregard anything I write here )

Sometimes my language usage seems confusing - please feel free to 'read it twice', just in case !
Ya know, you can find the answer to your question with the advanced search tool, when using a PC? Ditch the handphone, come back later on a PC, and try again.

I just moved back to the states about a week ago, lived in HCMC for about 4 1/2 years, married a little sweetheart about 2 years ago. Last year I asked the consulate/immigration about DCF and they replied that cant be done in VN. But we visited the immigration again (Diamond Plaza office) and was told they now accept DCF. Not sure if I was told correct the first time, but thats VietNam!

My problem is I havent filed US tax returns since moving to VN in 2006! I need time to go back and file back taxes, but wanted to file the I-130 ASAP so we will be together again soon, I hope.

But if I understand correctly, the I-864 is filed with NVC.

ah - so you aren't doing the I-130 to HCMC. got it .

Yup - can file the I-130 petition now, not worry about taxes or I-864 for about 5 months (the span o time you can expect to wait for the I-130 approval).

So that's 5 months to 'fix yer taxes' after filing the I-130 petition to Chicago.
