Visiting during I-130 Petition

Plans have pretty much fell through for me to go visit my husband in the UK. He was saying about coming back here to visit for a week or two, but he has been questioned the last 2 visits here. Is it a good idea to still have him try again or should we just count on not being able to see each other for a lot longer?

He recently got a job with the NHS, hasn't officially started yet (going through the background check) So he has that he can present, plus out NOA1.. Other than that he has no rental agreement or anything in his name.

Either that or if someone has any other ideas where him and I can see each other for a week or two.. Like both flying to Spain or something.. lol.. We just wanna see eachother you know.. :/

HE can come again why not..? Every visitor will be questioned. What were the questions about? He left which is a good thing. Just to be safe he can walk with any evidence of ties that he has to the UK so perhaps using the job offer letter if that is all he has.

Well you you travel to The Bahamas.. it's reasonably cheap. He can meet you in Jamaica.. Dominican Republic.. Pretty much any of the Caribbean countries he would not be required to have a Visa and i'm sure the questions would be less. If you feel like driving and not flying... You both can meet in Canada.

I was also questioned the last 2 times I entered the US, and this has also made my nervous. We're trying to drag out Nick coming over here as it will be my turn next so im just hoping we get the approval through and get NVC moving so I dont have to even try.

My personal opinion is that if I was turned away, the experience would be extremely traumatic for me. Having no phone, having to wait for the next flight back as well as possible questioning when I arrive back in England makes me not even want to bother trying, as I think i would just be a wreck!

However, if your husband is of a calmer disposition than me, id say go for it! While it would be terrible for him to be turned away, as long as he stays calm and answers their questions directly, i dont see there being too much of an issue. I see more people being successful than being turned away here on VJ.

To back up his evidence of return, think of everything. Does he have a cell phone bill. Schedule a dentist appointment for after his return. Also, if he is living with parents/friends rather than renting, get them to write a letter stating that he is expected back!

With a return ticket, and the NOA1 and job offer available if requested, he should be fine, especially if he is only going to visit for a couple of weeks. There are no guarantees of course.

Past experiences when visiting don't really portend anything for future visits. Some border agents are suspicious of anyone visiting a friend, others are just happy for the spouses of US citizens and feel compassion for you having to be apart and do all the paperwork.

He was questioned because he didn't know the VWP was good for 2 years so he applied again for the next visit.

So does he say he is visiting his wife?

From what ive seen here some people go with the route of just saying it outright. This will obviously raise more questions, but answer calmly and should be fine!

Others go with the "visiting family and friends" option, but this often raises the question "who" and when he admits wife it may make them think he was hiding something.

The general rule is keep answers short and sweet, and remember the point of WHY would I have wasted all my money and time filing out forms if I was just going to abandon it!

We are going to give it a go. He is going to come here the first week of March. I am confident that everything will be fine. He will have a job letter (NHS) and rental letter, any current info from our petition, a return ticket for 11 days later. In no way do I think we will have a problem with anything.. but I do know the chances.

All I know is its going to be an awesome 11 days!

P.S. Just going to say visiting wife and family. He has a very calm demeanor do that wont be a problem they have pulled him aside before and he has kept his cool. I'd rather tell them straight out then beating around the bush and them getting annoyed.. I will def tell you how it goes..

Thats my problem, my usual calm and cool demeanour goes straight out of the window and I turn into a jibbering wreck!
