Green Card Not Yet Received

Hi,

My parents arrived here back in October 2010. I am a US citizen and I petitioned them on an Immediate relative visa. They still have not received their green cards which I am very surprised about since I thought they usually arrive within a month or two. Has anyone else had this happen and if you could provide me with a telephone number to USCIS that I could call to find out what is going on I would really appreciate it.

02/23/10 - Assigned Case Numbers for both applications

If you live close enough to your local office I'd suggest scheduling an infopass appointment there. You might get the same info as you would on the phone but I've found the office to be much easier to speak to and more accommodating than the misinformation line.

Unfortunately the nearest office is 3 hours away.

But now I am a little worried becuase I follwed the guides to a T and when my mum called USCIS yesterday she was told that she was meant to have filed an I-485 (Adjustment of Status) once she arrived in the US. I can't find any instructions that say that should be filed neither can I see in the instructions that it should have been filed at any point during the visa application process. I know when you come on K1/K3 that you have to but I didn't think you had to when coming over as an innediate relative (parents of a US citizen). And, I looked through that form and its instructions and it doesn't seem to apply. After following everyones journeys on here that were petitioning for their parents I haven't noticed that they filed the I-485 either - so I am stumped about what to do. I guess maybe call an immigration attorney to see what they suggest or make the trek to the nearest office to see if they can help?

Any ideas or suggestions would be greatly appreciated.

Hello there! Sorry to hear that your parents have not received their GC's yet. This should not be so!

So, if I were you, first of all I would call USCIS 1-800-375-5283 and speak with a person who would give me an idea of your parents' cases status. I am sure they will be able to at least identify what exactly happened with their Green Cards. Your parents do not need to file any extra paperwork once you files for them and they were issued their immigrant visas to come here. When they cross the US border, they were supposed to give the package to the officers and then just wait till their Green Cards come in mail. Maybe there is mistake on a mailing address your parents provided?

I would schedule an Info-Pass appointment only after I personally talk to USCIS about each of my parents' cases.

2010-10-08: NOA1 email and text notification received. Both checks cashed.

2010-10-08: Case numbers assigned: both cases sent to California Service Center. Cases available online.

2010-10-15: NOA1 hardcopy received by mail.

2010-10-18: Both cases "Touched" online.

2011-01-21: NOA2 email received. Cases approved in 3.5 months.

2011-01-27: NVC entered both cases in the system. Auto update by phone.

2011-01-28: Called NVC to update my email address.

2011-01-29: NOA2 hardcopy received by mail.

2011-01-31: NVC sent me emails about AOS fee and Choice of Agent forms. Paid AOS fee of $88.

2011-02-03: Mailed 2 forms (for both parents) I-864EZ, Affidavit Of Support to NVC.

2011-02-07: Called NVC: IV Bill fee is ready to be paid. $404x2 paid for both parents online.

2011-02-08: IV Bill fee status online: PAID. Printed Document Cover Sheet.

2011-02-09: Received email from NVC asking to complete an Application for Immigrant Visa.

2011-02-12: Mailed DS-230 packets for both parents to NVC via express mail.

2011-02-14: Recieved USPS confirmation that DS-230 packets were delivered to NVC on FEB 14, 2011.

2011-03-01: Called NVC: they received DS-230 and biographic data on FEB 28, 2011.

2011-03-11: Both cases completed!

2011-03-26: Received email from NVC: interview for parents scheduled for May 9, 2011 in Warsaw, Poland.

Did parents ever receive the Welcome to USA notices (one or more)? That normally means cards are on the way (though not always).

The stamp in their passport on their immigrant visas is a temporary green card and is good for one year from date of stamping. With this they can get their SSNs, DLs, bank accounts...

Definitely no adjustment of status needed when someone enters on an immigrant visa.

I'd first try to escalate it through mis-information line and if that fails, contact your congressman's aide for immigration - they're there to liaise between you and a federal agency.

Thank you all for your help. No, they haven't received their welcome to America letter yet but they received their ssn's within 2-3 weeks. It's strange that they received those but not the GC's.

I'll try the USCIS again and if they still can't get it figured out I'll schedule an infopass.
