Can someone plz advice me as to how to proceed with the DCF; i have my I 130 pending with uscis TSC since 5 months now; filed in Aug 2010; case transfered from csc to tsc for faster processing; anyway; i will be visiting india next month; can i file for I130 in new delhi without cancelling w/uscis; once new delhi accepts i 130 can i cancel w/uscis in usa; does anyone have any input as far as applying from india; even if i cancel it from here how long does it usually take to cancel it...i feel like i should go to new delhi and file it from there and give it a try..thanks in advance..

It's my understanding you'd need to either get your petition transfered to DCF processing, or cancel before filing a new one via DCF. But I'd keep with the current petition- it probably won't save you much time, if any, to go the DCF route. You'd need to reside in India for 6 months (though some US consulates in India have accepted DCF submissions after 3 months) before even filing.

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.
