I know that there is a 3 year (For people married to US Citizens) and 5 years( regular) waiting before you can apply for citizenship. My question is that you have to wait after 3 or 5 years period pass or you can send the application 3 months before end of 3 or 5 years?..Thanks

You can file up to 90 days before you meet the 3 or 5 year eligibility requirement. Remember that 3 months is not equal to 90 days.

Naturalization

3/23/14 - N400 package sent to Phoenix

3/27/14 - N400 package delivered

4/3/14 - NOA1 receipt date

4/4/14 - check cashed

04/29/14 - biometrics date

07/01/14 - interview date

xx/xx/xx - Oath Ceremony

You can send it within 90 days prior to 3 or 5 years of LPR status.

90 days is slightly less than 3 months.

If you live in CA for two months, then relocate to NY, you must wait 3 months before you can file N-400

There is a provision that mentions being allowed to file 90 days prior to being eligible, but this only applies to the "continuous residency" provision, that is, if you had been a PR for 5 years, but only continuously resident for 27 months (instead of the required 30), you could apply in anticipation of meeting the requirement. But this does not apply to the requirement of 5-years of PR status. This MUST be met prior to filing

Thanks everybody for your replies. Is there any link where I can see this 90 days provision because I looked at original N400 and it clearly says that you have to be permanent resident for 3 or 5 years based on your case to be able to apply... Thanks
