Hi BJ's, My conditional greencard stated that my start of US resident was May 23,2008 and I already Removed the condition and received a 10 yr green card. My father passed away last year so i went back to my country Dated April 20,2010 and Return back here On US last May 17,2010. May I know when i can file my N400? coz I'm worried that I suppose to complete the 3 years before going outside the US but something happened that need me to go back to my country. Am I still qualify this year to file N400? also, can I file my N400 90 days before my 3 year Thank you so much hope someone here in Vj can help me to answer my question. Regards, Calendar Girl

You can file the N-400 starting sometime within 90 days prior to May 23 of this year. The 3 or 5 years begins the moment you are approved for residency which was May 23, 3 years married to same US citizen, 5 years if not.

What resets it would be a period of absence from the USA of 6 months or longer, your trip was for about 1 month.

Also total time in the US needs to be at least 18 months of the 3 years.

Is now a US Citizen immigration completed Jan 12, 2012.

You were out of the country for less than a month, not a problem, assume you are married and applying for the marriage privilege of three years and if you were married the full three years 90 days before May 23, 2011 can apply at that date. You can date your application and mail it in February 23, 2011 provided you were married three full years on February 23, 2011.
