Hello all,

My Fiance and I have submitted his K1 visa application, and should hopefully get an approval in a few months (fingers crossed!!!). Our plan is to get married AS SOON as he arrives in the US - but we have one major issue. We would like to have a "ceremony" in the Caribbean for our close family and friends in early 2012, but I'm worried that we won't have his green card in time to travel. This is our timeline;

Filed K1 in SEPTEMBER

Approval by MARCH (6 months)

Fiancee arrives/get married/file AOS in OCTOBER

Caribbean ceremony in MAY 2012

So with that said,

1. How long does the Green Card take to process once we've submitted the package?

2. How long does the AP take? Is this a one-time only use? Does it GUARANTEE re-entry into the US? (We'd be out of the country for a week MAX), and lastly;

3. Are there conditions to RECIEVE a AP? From what i've been researching, it seems to be humanitarian works only?

Please advise!

Thanks a million & Warmest regards....

Count on getting your NOA2 in March, not approval. Then it goes to NVC and on to your embassy for interview which can take anywhere from another few weeks to months. That being said if you file for AOS ASAP after marriage it will probably take 4 months total to get the greencard. AP takes around 60 days from filing, it can be one time or multiple depending what you ask for on the application. Nothing guarantees entry into the US other than citizenship really but as long as there are no problems you should be let in just fine with it. However, remember that you may be called for interview for AOS and you don't want to be out of the country on the day you have the interview. There are really no conditions to receive AP, most are approved I believe, it is a pretty straight forward process. Hopefully your fiance will be a resident by then so it won't matter anyways. Good luck.

1) Green-card takes 4-6 months

2) AP can take 3-4 months to get, Yes AP guarantee re-entry, as well as continued process of AOS, that what is for.

3) No conditions, AP is a free benefit of AOS, no reason needed to apply for it.

OUR TIME LINE Please do a timeline it helps us all, thanks.

Just to quote Amy NOA2 is approval of petition but then it has to go to NVC and on to beneficiaries consulate/embassy but NOA2 does not guarantee approval of VISA which is up to consulate in beneficiaries country. My goodness if you are not fully approved and AOS'd and GC by May 2012 there is something definitely wrong with the system.

Just on your dates you filed Sept, you should be approved NOA2 end of March -April k (fingers crossed) then on to NVC and on to fiance country consulate by May lets say. Interview June maybe approved fiancee arrives July / August. Marry apply AOS Sept/ October sending in AP and EAD forms after bio get AP and EAD December this is heresay ok and then approval GC arrives Feb / March. No restriction AP darl. SO going on that and everyhting working like that yes by May no probs I would freak if you could not be ready by May next year.:thumbs:
