Timeline

Hi, I filed my case early in Nov' 10 and still have not heard anything about my AP.... I need to travel to my home country on urgent basis as my dad will be going through an eye cataract surgery .... And being the eldest daughter I would like to be there at the time of surgery ....

Now, here's a brief history of what I've done so far to get an AP ....

1) Called USCIS TWICE to expedite the AP request ..... Received emails from them saying that they do not find my request to be fulfilled at the time .....

2) Wrote my senator a letter, told him the whole situation and he was kind enough to send them a letter explaining my situation but I just spoke to her secretary and she told me that they refused it saying it's not an emergency situation according to their critarian.

NOW, I've 2 ways:

1) Ask for a letter from the doctor of my dad and send the request again through the senator (that's what her secretary also suggested me)

2) Get an infopass appointment and show them the letter from the doctor ....

Which one should I go for?? My dad has already lost his right eye's eyesight as a result of a cataract sugery which turned out complicated for him as he's a diabetic patient. Secondly, my sister is also getting married on the end of Jan .... My dad's surgery is on the 18th .... Is there ANY way I can get AP ??? I'm desperately waiting for it :(

I would appreciate any suggestions regarding this problem ..... Thanks VJ guys ....

I'm not sure that they will give you expedite on your AP if you keep trying, since they refused you 3 times already stating that it does not meet their criteria for expedite.

Your I-129f was approved in 5 days from your NOA1 date.

Your interview took 67 days from your I-129F NOA1 date.

AOS was approved in 2 months and 8 days without interview.

ROC was approved in 3 months and 2 days without interview.

I'm not sure that they will give you expedite on your AP if you keep trying, since they refused you 3 times already stating that it does not meet their criteria for expedite.

I know this may not sound ethical but I think you should mention 'serious health emergency' in family and get the letter from the doctor, if you can, that simply talks about surgery not an "Eye" surgery. I know they have something related to health/family emergency in their list.

Inky is right, even if you try again, its not going to help because an Eye surgery doesnt meet the requirement and quite honestly rightly so unless you can prove to him that your father is going to be all by himself and he needs someone to hold his hands after surgery etc. Having responsibility being the eldest doesnt cut it for them! My 2 cents.
