EAD possible if you have an RFE?

I got an RFE for initial evidence (relating to I485 - cosponsor didnt send a W2) at the same time I got a biometrics appointment letter (relating to I765).

Did my biometrics today thru walk-in. Don't think I can respond to the RFE until next week cuz I'm still waiting on my cosponsor.

Will they order production of my EAD anyway or will the process be frozen?

For what it's worth. I received an RFE, then went to biometrics, received EAD card and interview letter... And I've yet to reply to the RFE. The RFE was for a new copy of the I-693.

Adjustment of Status

11/03/10 ------- AoS (I-130/I-485) Package mailed out (Priority Mail)

11/07/10 ------- AoS Package received and singed for

11/10/10 ------- NOA1 received for I-130, I-485 and I-765 (emails)

11/12/10 ------- NOA1 received for I-130, I-485 and I-765 (hard copies)

11/12/10 ------- Touches on I-130, I-485 and I-765

11/19/10 ------- Biometrics appointment letter received

12/06/10 ------- RFE for I-693 (I think the issue is that it was not signed. Called USCIS and will receive a letter in a few days explaining)

12/13/10 ------- Biometrics done

12/16/10 ------- EAD card in production (email)

12/20/10 ------- Received "Letter of Explanation" for RFE (Service Request to expedite my case. Called USCIS and was told to ignore that and just send in response to RFE.)

12/22/10 ------- Touch (Email for Post Decision Activity on EAD saying that a letter of approval has been mailed out)

12/24/10 ------- Received EAD in the mail

12/27/10 ------- Applied for SSN

12/31/10 ------- Received Interview letter

01/03/11 ------- Received SSN card in the mail

01/07/11 ------- Mailed out response to RFE (I-693)

01/15/11 ------- Email confirming USCIS received RFE response

01/31/11 ------- Approved!

Pre-Adjustment of Status:

2006 -------- Met Online

02/07 ------- Visited him in the U.S. for what was suppose to be a few weeks (Came in with birth certificate and health card. Health card expired a few months after)

08/07 ------- Decided to get married because we didn't want to be apart (in the U.S.)

10/10 ------- USCIS Medical Done

Thanks for the anecdote. Out of curiosity - why haven't you replied to the RFE? Don't they deny the application altogether if you don't ever respond?

Your RFE has nothing to do with your I-765, so yes, it is possible to get the EAD before you submit the RFE. However, make sure you submit the RFE on time, so you won;t have any unpleasant surprises, like an I-130/I-485 denial and such.

Thanks for the anecdote. Out of curiosity - why haven't you replied to the RFE? Don't they deny the application altogether if you don't ever respond?

You get 87 days to reply to an RFE. I had to get my doctor to write out a new medical altogether because someone messed up the original one. I just got that and a day after, I got the interview letter. So I debated for a few days what to do. It's doing in the mail tomorrow. ;)

I didn't call to get my case expedited. I was a mistake on their part. But, to answer your question, I called the normal USCIS number. I guess that if called them and explained your issue and wish, they would most likely transfer you to someone who can help you further.

As for the EAD, I don't know. USCIS is a big complex thing hidden from our view. We only glimpse at it once it a while when it wants something from us or during interviews and such. But really, it's hard to figure out what will work.

I would have said "call and ask them"... but the last time I did that, I blurred the waters even more. :bonk:
