Hello everybody!!!

I came to USA under a K1 visa on october 29th. We decided that I would apply for SSN after getting married and have the marriage certificate so I apply straight changing my name. Ok, we couldn't get married till December 17th and just today (January 3rd we got our marriage certificate). We went right away to the SSN office and the woman in there made me the short interview questions (if i filed for taxes, if i applied for food stamps, if i applied for work in USA...). Then she made photocopies of my passport bio, K1 and I-94. At first she didn't want to give me an SSN because she said that my I-94 would expire IN A COUPLE OF DAYS (it expires on january 27 thus in 24 days). Ok, then she said that she would send all my papers to immigration for them to verify them and if my SSN application isn't denied I would have my SSN card in 4 weeks.

I asked her if it was any way to know the number before the card is issued and she said NO.

So my question is:

Can we go ahead with AOS if I can't write my SSN on the forms due to I don't know it yet?

I'm applying for EAD within AOS...does affect to the application that I don't know yet the SSN?

SSN is NOT a requirement to adjust status. You could file the I-485 shortly after marriage, when you have marriage certificate.

SSN is NOT a requirement for EAD.

In many cases like a K-2, K-3, K-4 they cannot get SSN until after they first file I-485, and I-765 and then use EAD to Green-care dot get SSN.

K-1 is authorized to get SSN shortly after entry to the USA for one reason only, several states comply with a US law, that requires a SSN in order to issue a marriage license.

Did she look you up on the S.A.V.E Database. If she had, then that is all the verification that she would have needed.

It sounds like she has done a manual verification with USCIS which will add a few weeks to the normal processing time, but as it has been said, you will not require it to fill out your AOS forms

Go back to the SSA office in 2 to 3 business days from the date you applied, with a copy of the letter they gave you showing you applied, with the reference number at the top. You can show ID and get a print out with your SSN on it. SSN's are generated at midnight on the night after the information is verified. (Example: DHS verified your immigration status in 2 days, it would generate at midnight on the third day.)

You CAN get your number before your card, but only YOU can get it. They won't release it to a spouse or anyone else. My husband did this, it was very easy.

It's also helpful to go in there with the reference number so that if there is something holding up your application (error in the database, like we had) you'll know about it sooner, rather than later.

Also, will I have any problem, denial or delay because I applied for my first SSN with my married name? (as she said she took photocopies of my passport and I-94 but who knows) because can happen that immigration tries to search me by my married name with no success...aaah I won't sleep quietly now...

This will not be a problem.

Most apply for SSN prior to marriage using maiden name and don't bother changing it until after getting green card, to remove the restriction notice on the SSN card.

I have seen cases where SSA officer simply refuses to issue SSN after marriage siting the reason for issuing SSN to K-1 holder no longer exists, applying for marriage license, and says need EAD or Green Car.

This is very interesting. I am also a k1 filer and I move to the US next month (visa has been approved). Does this mean I should apply for a SSN before getting a marriage license? Can someone guide me as to the right process once I move to the US as to what I should do first?

My Journey:

We met through a study-abroad program in Shanghai, China in August of 2009

We got engaged March of 2010

I received my K1 VISA in 6 months (June-December 2010)

We were married 04/02/2011
I received my conditional 2-year greencard (AOS) in 2.5 months with no interview (April-June 2011)

Our son was born 02/03/2013

I received my masters degree in Speech-Language Pathology 04/17/2013

I received my 10-year greencard (ROC) in 3 months with no interview (March-June 2013)

My husband returned from deployment 06/20/2013

My naturalization journey took 4 months (April-August 2014)

I became a US citizen on 08/01/2014

Received passport in 3 weeks (regular processing)

Well, this officer didn't reject to do the SSN card in the married name. She just told me that it may be longer due to the name change. So I guess and hope that she just sent to immigration my I-94 and K1 which she photocopied together with my SS5 information where i specified the name that i wanted to be in my SSN card (married) and another names used (maiden) so they will be able to find me in the system...I guess that will be a matter of waiting if she did her job.
