Income Requirements

Hi everyone -

I have a question regarding income requirements. My income is normally about double the minimum income requirements for 2 people for a K1 visa. However, I lived and worked in Africa for part of 2008 and most of 2009. During that time I was paid cash and did not receive receipts. I also did not claim this income on my U.S. taxes as you can earn up to $80,000 outside of the U.S. without having to report it. So, the amount on my 2009 tax return is about half of the minimum requirements needed for a K1 visa.

I have worked in the U.S. for all of 2010, so for this year my income is again well over the requirements. I am not sure that I will have my 2010 tax return by the time my fiance has his interview. I am planning on sending him copies of my pay stubs for all of 2010, and I also have an employment verification letter stating my current income.

But now I'm getting worried of a possible visa denial because of the low 2009 income. 2009 is the only year that I did not meet the requirements. Should I try to secure a co-sponsor because of this? Or would they tend to look more at my current, 2010 income (even though I might not be able to provide a copy of a 2010 return yet?).

You should have plenty of time to include your 2010 income taxes plus you will have a letter from your employer along with several pay stubs before the interview that will show your above the 125% poverty levels. All the best!

Thanks, I hope so...I think I probably won't have a copy of my 2010 return until mid-February, and from what I understand Malawi is pretty quick for scheduling interviews, so his interview very well might be in January. I guess I will just cross my fingers that whatever information I have for 2010 will suffice in that case!
