If anyone can help me with some info, I might be able to make an informed decision with this. I have been married for 5 years, after commuting from Canada to USA for sevenof years,(with a large file of papers)no problems until June when I was denied entry, twice-mostly because of the ongoing visa process and the fact that someone(his Ex-wife) in USA told Homeland I was residing in the US .So now I am flagged until a visa is aquired. In the mean time ,my parents have both become ill and require my attention so I am residing with them in Canada and told my husband I need to wait. In a nutshell, if I withdraw the visa application, what am I going to need to be able to just visit America-we are heading for divorce(the physical seperation put him into the arms of another). I know the seperation has ruined my marriage, I thought he was a stronger man than this.

My dilema is -since I have been denied entry twice , what kind of paperwork will I need to prove I have no intentions to reside in America, should I want to holiday there or shop etc.

The usual asked from every tourist - proof of employment, letter from employer stating your dates of vacation and expected date of return to work, return ticket, mortgage or apartment rental agreement, bank statements, hotel reservations...

There was a recent youtube Am/Can border crossing video where a tourist who was going to visit outlets on US border (travel by car) could not even tell the border guy which store he wanted to visit - and yes, they do ask those questions so in shopping situations, you better know your answer. The person in question got detained alongside his spouse - I believe for 7 hrs.

I Know what it feels like to be escorted bt two gaurds into the office-I am 55 and have been going across the border off and on for the last 7 years with no issues, then out of nowhere I was told by an officer "Iam going to ask you some questions today and you better answer them right because it is not looking good for you" I was speachless and it has taken me months to even discover what their problem was with me. I guess now with changing the visa course midstream I am apprehensive and wondering if this is going to create a who;e new set of problems. By the way, can you tell me the best way to stop the process. I was going to call NVC but I wondered if I should have sent an e-mail letter from both myself and my soon to be ex-

Here's my totally speculative .02:

Since you're within driving distance of the border, I'd do a dry run and go again. I'd take all my documentation with me....divorce documents, proof of ties to Canada, etc.

Maybe someone will come along here and give better, more informed advice. I don't really know the ins and outs of clearing this up, but that's what I'd do. You might need to now start applying for a visitor's visa because of the border denial...I'm not really sure...as I said, hopefully someone will come along with concrete knowledge instead of speculation.

Good luck, and btw...I'm sorry about your marriage breaking up, and your parents falling ill. I don't normally chime in when I'm purely speculating as I generally feel it's bad to offer advice without knowing for certain, but my heart went out to you. It's not easy when a long term relationship goes south because of the distance. It happened to me as well, actually...we weren't married, but we were together for 8 years...lived together for about 5 of them. For me, like you, infidelity is a dealbreaker. About a month before his interview when I found out, I promptly severed all ties.

I couldn't be happier now, and I am now married to the absolute love of my life. It's crazy how life works out.
