Sir,

I have applied I130 and I129F for my spouse and got the approval for both applications the same day.

I guess we will have to go thru' the CR route. My question here is regarding affidavit of support I-864.

I am an IT person who was earning well enough. But was laid off few months back.

Since then I have been getting unemployment compensation. I am trying for a new job, but it is taking time.

My questions are:

1) Will receiving unemployment compensation be an issue with the NVC, while filing I-864?

2) How much bank balance is considered enough that I will not need a co-sponsor?

3) Is this co-sponsorship requirement based on

a) current earnings OR

b) bank balance OR

c) how much your earning was in the past and how much you are capable of making in the future.

Hope my previous 3 yr tax return statements will prove my good earning ability.

Anyone, please advise. Thank You and God Bless...

2) 125% Poverty line * 3 (Savings is used as an asset and assumes it needs to last at least until prospective immigrant becomes able to become a US Citizen, which is 3 years after getting green-card when married to a US Citizen) ($18,212 * 3 = 54,636)

3) Joint sponsor is based on if your income + Assets/3 falls below 125% poverty line)

As a continuation I would like to get one more query clarified.

You said 'Savings is used as an asset and should be $18,212 * 3 = $54,636'.

1) Does this asset include other savings like 401K, properties like current vehicle value, valuable jewelry, etc. too?

2) Also if the petitioner has land property out of country which can be sold (if required), can that be counted too?

This is explained pretty clearly in the excellent I-864 instructions. Don't expect your unemployment income to carry the day, as it's known to be temporary. You can list it and its source but document your assets. The full balance of the 401k should be disclosed but will not be factored based on full balance. Liquidating 401k accounts is expensive. The Consulate will calculate that cost including penalties and taxes before using the projected remaining balance. If you don't easily exceed the need for assets, get a joint sponsor.
