Hello All,

I read where some k1 applicants had to start over with the application process because immigration took too long to approve their K1 petition. Is there a time limit for the K1 petition to be approved by USCIS before it is rejected by the consulate? I can see the USCIS is overloaded with applications and so the 5 month goal may not be possible at this time. Its been a little over two months and I am getting anxious.

The K-1 process is a linear one; the first step must be completed before the second step starts, so there is no time limit to the steps. If USCIS takes 100 years to approve the petition, then after that approval NVC gets the case. If they take 100 years to approve the petition, then it is sent to the Embassy. If the Embassy takes 100 years to do their AP before issuing an interview date, then that is what it takes.

No applicants ever had to refile because one of the steps took too long.

Thank you Baron. I thought I read a post on this site about a couple who decided to get married after their K1 application was denied because the USCIS agent took too long to approve their case.

That sometimes happens AFTER a denial. Ie case is processed, interview happens, visa is denied. Technically, what is supposed to happen is the case is sent back to the USA and looked at by USCIS, who either re-affirm and sent it back to the embassy or uphold the denial. What has happen in many cases where the couple isn't proactive is that the service center just lets the case sit until it "expires". So if you get denied, be sure to chase up the case by contacting them/ your senator/ a lawyer.

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

A little over two months is nothing close to 5 months. No need to get anxious, though I know it is easier said than done, but it really will do no good. They are going to adjudicate your petition when they do. No sooner, no later. In the mean time, try to plan a life with your loved one, clean the house, redecorate, empty closets, go to the gym to look better for your wedding day, etc. Try to use your energy in productive ways. I know waiting is hard, but it will all be in the past soon enough.

August 23, 2010 - I-129 F package sent via USPS priority mail with delivery confirmation.

August 30, 2010 - Per Department of Homeland Security (DHS) e-mail, petition received and routed to California Service Center for processing. Check cashed. I-797C Notice of Action by mail (NOA 1) - Received date 08/25/2010. Notice date 08/27/2010.

After 150 days of imposed anxious patience...

January 24, 2011 - Per USCIS website, petition approved and notice mailed.

January 31, 2011 - Approval receipt notice (NOA 2) received by mail. Called NVC, given Santo Domingo case number, and informed that petition was sent same day to consulate.

Called Visa Specialist at the Department of State every day for a case update. Informed of interview date on February, 16 2011. Informed that packet was mailed to fiance on February, 15 2011.

February 21, 2011 - Fiance has not yet received packet. Called 1-877-804-5402 (Visa Information Center of the United States Embassy) to request a duplicate packet in person pick-up at the US consulate in Santo Domingo. Packet can be picked-up by fiance on 02/28.

March 1, 2011 - Medical exam completed at Consultorios de Visa in Santo Domingo.

March 9, 2011 at 6 AM - Interview, approved!

March 18, 2011 - POE together. JFK and O'Hare airports. Legal wedding: May 16, 2011.
