I'm just giving you an example of my case, however it may not be relevant to your situation. I have never been married before, however my husband (non-USC) was previously married to a USC and gained conditional residency. He seperated from his wife after two years and divorce papers werent completed for another two years (at that time he was already with someone else and had two children) This made our case look as if he only married his first wife for papers while living with another woman. Which was absolutely not the case. Our interview was denied and I had to provide extensive amounts of information to overturn the denial. We were re-approved, but if I was prepared with such evidence at interveiw then it may have saved us a lengthy reveiw.

It's better to be proactive than re-active. If you are having concerns about how your case looks than you can assume the officer will have concerns. Be prepared to provide evidence that would change your own mind and the officer's.

Everything in the petition is examined as a whole. The most important thing about divorces is that you are both officially divorced before filing the K1. You both need your final divorce decrees in hand and must send the copies of the signed and dated divorce decrees with your petition packet. I know of a fellow member with a Dominican beneficiary who was denied the K1 visa because it turns out that her divorce was not yet final at the time of submitting the petition. This was devastating news to her and her fiance. So, make sure that your affairs are in order before sending the petition. There have been many members approved even though they were previously married and had children. So it's not, by itself, a deal breaker.
